Today the USEPA designated two widely used “forever chemicals” as hazardous substances under the United States’ Superfund law on Friday. The news release also included a separate publication of the PFAS Enforcement Discretion and Settlement Policy Under CERCLA which states that the "EPA does not intend to pursue entities where equitable factors do not support seeking response actions or costs under CERCLA, including, but not limited to, community water systems and publicly owned treatment works, municipal separate storm sewer systems, publicly owned/operated municipal solid waste landfills, publicly owned airports and local fire departments, and farms where biosolids are applied to the land." However, big questions remain: Will Superfund sites that were considered cleaned up, but have PFOS or PFOA be reopened for cleanup? Will more PFAS compounds be designated as hazardous substances and require even more removals? This is the first time that EPA has used its authority under CERCLA section 102(a), will it hold up in court? Time will tell.

Asbestos fly tipping. The post by Arlene Barclay and accompanying video is another example of illegal fly tipping of asbestos waste of which there are thousands of similar occurrences in the UK each year. This looks like a tipper truck loaded with asbestos cement roofing sheets has been purposefully dumped from a slowly moving vehicle. Not only does the landowner or highways dept have to pay for the cost of the road clean up, those removing the sheets handling the sheets etc before they ended up in the tipper truck are highly likely to have been exposed to airborne asbestos fibre, and the site the sheets originated from is likely to have asbestos debris and dust risking further worker exposure. Dumping of asbestos or any other hazardous material is pretty much always done to make a profit by breaking the rules because the risk is seen as worth it. It’s time to get serious with these criminals and when they get caught legislation needs beefing up so courts can confiscate personal and business assets to pay for the clean up and proper disposal, those involved being banned from being a director of a company, and 6 months minimal prison sentence. The polluter has to been seen to pay by the public. This isn’t a three strikes and your out situation, a relatively small group of people are responsible for repeat hazardous waste violations with a callous disregard for other people’s safety. Only through regularly published news items about convictions and severe punishments will it sink in with the criminals involved that it is never acceptable to fly tip hazardous waste. Also in need of addressing is the ‘producer’ of this type of fly tipped waste not caring where their refurb or demolition waste goes. If asbestos or hazardous waste is traced back to a property or site and the property or site owner hasn’t taken adequate steps to get proof of proper disposal, they need to be prosceucted also, again with regular press releases as a deterant to against those tempted to ‘turn a blind eye’. Arlene, I hope you find those responsible and that they get the book thrown at them.
*** URGENT REQUEST - APPEALING FOR WITNESSES - CRAIBSTONE ESTATE, ABERDEEN *** SRUC and Cala Homes are appealing for witnesses and local support. Please approach the rear of Craibstone Estate with extreme caution due to industrial quantities of asbestos illegally dumped on the road. We hope this post will help raise local public safety awareness. For safety reasons, SRUC and Cala have advised Aberdeen staff, students and Craibstone estate residents not to use this road for the foreseeable future. Environmental professionals have hard enough net zero targets to achieve, without losing productivity by having to contend with hazardous materials illegally dumped by 3rd parties. Whoever is responsible has shown zero respect for land owners, the environment and public safety. Cala Homes and SRUC have each notified Police Scotland and have further appealed for witnesses through local social media platform Fubar News. SRUC have notified SEPA (a SEPA incident report has been submitted) and Transport Scotland (AWPR section). Cala have notified ACC and are currently reviewing their CCTV. We have managed to establish (through Craibstone residents) the event occurred during a 12 hour period - 5pm Sunday 29th September till 5:15am this morning. Tomato tomahto I always use the term 'Off Mains Drainage', but the majority of the legal profession use 'Private Drainage' - different labels for exactly the same thing. It's the same with the 'General Binding Rules' - everyone uses this label apart from the very people who police it, the Environment Agency, who prefer to use SSD (Small Sewage Discharge). The full title is 'Small Sewage Discharge General Binding Rules' so again we're all talking about the same thing, but it made me think whether there's a need or an opportunity to standardise these for the benefit of buyers, sellers and all the professional stakeholders involved with property transactions. I've always been a firm believer that using terminology that resonates with the audience is both polite and the very best way of minimising miscommunications, but am I overthinking this? #languagebarriers #standardisation
