The U.S. House of Representatives recently passed the bipartisan Lower Costs, More Transparency (LCMT) Act, a bill that strengthens and clarifies existing healthcare price transparency laws. While this is a great first step, the real issue lies in the lack of aggressive enforcement of existing regulations aimed at increasing transparency. According to a recent article, only 36% of American hospitals reviewed were fully complying with the Hospital Price Transparency Rule that went into effect on Jan 1, 2021. This begs the question: why isn't enforcement more aggressive? Hospitals and payers must not believe enforcement or penalties are a real threat.
