Contractual or common law tenancy This is the most common type of contractual tenancy. It is for individuals where the rent exceeds £100,000 per annum. In these cases, the agreement is a standard common law contract between two parties. A contractual tenancy must have all the necessary provisions incorporated into the Agreement itself. Both parties have the freedom to contract as they choose, but must then rely solely on the provisions of that Agreement that are not governed by the Housing Acts. #cardealettings #lettings #landlords #tenants #property

You and your tenant may have made arrangements about the tenancy, which will be part of the tenancy agreement (as long as they don’t conflict with the law). Remember that your tenancy agreement can give you and your tenant more than your statutory rights but can’t give you less than your statutory rights. Did you know? A tenant, no matter the length of his tenancy is not entitled to the right of occupancy over the land on which he occupies. This is as a result of the fact that the right of occupancy resides in the owner of the property i.e the landlord. Trust you've learnt something. Do let us know in the comments.
