📢 Paid Leave - “Topping Off” or Supplementing Benefits in Mandated States As we’ve seen in recent years, we anticipate the continuing trend of states enacting new mandated paid leave laws. Currently there are roughly 15 states with mandated leave, and another 3 with voluntary programs. While many of these states provide robust benefits, up to 90% income replacement, they nearly all include caps on weekly benefits, often limiting the amounts claimants receive to far less than full replacement. 👉 To that point, several of the existing and upcoming paid leave states include language permitting the use of PTO to supplement or “top off” state benefits, up to 100% of regular wages or salary. 👉 While some states, like Massachusetts, include explicit “top off” language, others simply require mutual agreement between employer and employees. These include: Colorado, Maryland, Minnesota, NY (PFL), Oregon, Rhode Island. More momentum on paid leave in Congress! On July 10, the House Appropriations Committee passed a FY 2025 Labor-related funding bill that includes language in its report to highlight how the variations and different requirements in the 13 states and DC with paid leave programs create complex challenges for workers and employers to navigate. Understanding how state paid leave programs coordinate with and compare to the value of employer-provided leave is critical to drive harmonization of these benefits across the country – which would go a long way to improving simplicity and access. While the funding bill has not yet passed through Congress, this incremental progress is a meaningful step towards building consensus. https://lnkd.in/ejYUvN6H
