When tasked with determining parental rights, the New York courts generally aim to maintain the parent-child relationship, but the health and welfare of the child is their paramount concern. As such, in some cases, they will find it to be in a child’s best interests to limit a parent’s access to a child or order the parent to undergo certain steps before they award them custody rights. In such instances, the affected parent typically cannot obtain a modification of the order absent a showing of a substantial change in circumstances, as discussed in an opinion recently issued by a New York court. I think #ellewoods said it best, "Why now? Why this sperm?" And she had a point! In a lot of #childcustody cases, dad has been a #deadbeat , almost completely absent, or an inconsistent presence at best. The problem is, though, that most #familycourts today think that even a bad dad is better than no dad at all, so they'll give these absentee dudes #parentingtime . It's good for kids, right? Who knows? I mean, we're #Lawyers and #judges , right? We're not child welfare experts! Even if your child's father hasn't been particularly involved, his sudden interest in having parenting time is a concern - and you should take it seriously. Consult with an attorney in your state, and don't just assume that because he's never had an overnight or hasn't shown up consistently before that he won't get time now. We have a lot of these types of cases - we call them #reunification cases - and dads get more parenting time than, in most cases, moms believe is good for the kids. (And, let's be real: As a mom myself, I totally agree!) Custody and visitation cases are supposed to be about the CHILD'S best interests, not about dad's "rights" to #custody and #visitation ! (For the record, it's not about mom's rights, either, but moms seem more intuitively able to grasp the difference between their rights and their children's rights. Just an observation.)

Culturally specific units supporting disproportionately, significantly over-represented, Black parents and children fall in the same category as language specific units. #Equity #Representation #EducationForAll Equity in child welfare is the fair and consistent treatment of all people, including and especially for those from disproportionately impacted and underrepresented communities. ⚖️ On the basis of what? Race? or Ethnicity? Race refers to "dividing people into groups, often based on physical characteristics". Ethnicity refers to the cultural expression and identification of people of different geographic regions, including their customs, history, language, and religion, which sounds more amenable to the goals of establishing an equitable framework for child welfare services delivery that could achieve and sustain consistent and fair treatment of all people. https://lnkd.in/gkVsjsTm Words matter. Establishing equity should include starting the conversation with a shared understanding of the goal. We can’t “Transform” something that doesn’t exist. America does not have a “child welfare system.” The system we have been trained to call "child welfare" is codified in federal law - the Child Abuse Prevention and Treatment Act (CAPTA, 1974) as "child protective services" (CPS) - is a family policing, family regulation, family destruction system. The 4 core components of CPS required by states to receive the extremely small amount of money under Title I of CAPTA ("budget dust" per Richard Wexler) are: surveillance ("mandated reporting"), investigation (looking for wrongdoing), court prosecution, and "treatment/services". None of these government activities are geared to promoting the "welfare of the child"; indeed, there is no evidence that any of these activities actually promote children's safety, stability (permanency), or wellbeing. https://lnkd.in/gSvUXAcZ We can and we must act aggressively, with Urgency, to end the horror that children and families endure in the “child protective services/CPS/foster” industry.
