The Committee remains dedicated to advancing members’ vision and recommendations to develop efficient and balanced competition policies and legislation, aligned with EU procedures and best practices. These policies will foster economic growth, wealth, and job creation by ensuring a level playing field for businesses. Additionally, the State Aid group continues to advocate for an EU-compliant state-aid policy to enhance Romania’s attractiveness and competitiveness. The committee's current 𝐟𝐨𝐜𝐮𝐬 𝐚𝐫𝐞𝐚𝐬 include: ➡ Providing recommendations on primary and secondary legislation in fields such as antitrust, FDI screening, and merger control, ➡ Advocating on the implementation of the Office of Hearing Officer, ➡ Develop recommendations for future state-aid schemes and identify the unique advantages of Romania as an investment location compared to other countries. For the 2024 mandate, 𝐀𝐦𝐂𝐡𝐚𝐦 𝐁𝐨𝐚𝐫𝐝 𝐦𝐞𝐦𝐛𝐞r Gabriela Popescu, Corporate, External, and Legal Affairs Lead for Central Europe at Microsoft Romania will serve as 𝐂𝐡𝐚𝐢𝐫. TIME LIMITATIONS FOR RECOGNITION AND ENFORCEMENT OF FOREIGN ARBITRAL AWARDS IN UZBEKISTAN As you may know, the NYC remains silent on the applicable time limitations for applications on recognition and enforcement of foreign arbitral awards, and thus states are entitled to specify the timing under Article III of the NYC. Tashkent city Economic Court touched upon this matter in its order. A foreign company initiated an action on recognition and enforcement of an ICC award made on April 27, 2020. The applicant in its application argued that (i) the grounds for refusal indicated in Article V of NYC are exhaustive, and (ii) the Convention itself does not include a time limitation for enforcement action. Also, (iii) he claims the supremacy of international agreements/norms over national law which provides a three-year time limit. Pursuant to Article 248 of Code of Economic Procedure, the aforementioned time limitation is three years starting from the date which a foreign arbitral award takes effect. The applications made after passing the time limitation are rejected by the court as per Resolution of Plenum of Supreme Court No. 27 dated November 20, 2023. Tashkent city Economic Court rejected the application on recognition and enforcement of an ICC award based on the grounds stated above. The interesting point is here that an enforcement application may be dismissed only if the grounds stated article V of NYC is in place. In turn, article V of NYC does not provide time limitations as Applicant argues.
