"the investment professionals have basically pushed out the attorneys from interpreting fiduciary duty" - Keith Johnson We attorneys need to push our way back in, to push "the investment professionals" out, and bring reasonable people back to common sense. We need to set Fiduciary Money, entrusted by law to the fiduciary duty of Pensions & Endowments, free from control by the Markets, and set this money to work taking control of our global energy supply ecosystems, so they can be reconfigured for energy sufficiency with habitat longevity and social equity. We need to upgrade the common sense of reasonable people about the purpose of Pensions, the needs of Enterprise and the purpose of Markets, to see that it makes no sense to interject Markets between Pensions and Enterprise. Pensions as financiers need longevity at scale. Enterprise needs longevity at scale in its financings. There is a direct match: longevity to longevity. As individuals, we do not need longevity. Or scale. We need liquidity. In increments. The Markets are purpose-built to mediate this tension between us, as individuals, as investors, who need liquidity in increments in our investments, and the need of Enterprise for liquidity at scale. continued...
