What a great day today has been, delivering training to a client firm. I always tailor any training to the individual firm's business model and needs, and this was rewarded by great participation and discussion. There may be those wondering how compliance training can be fun but we had lots of laughs - particularly when discussing the finer points of anti-bribery, gifts & hospitality and conflicts of interest, given current political headlines! #compliance #training

The recent decision in TA v the Public Guardian [2023] highlights the importance of the role of a certificate provider in preparing an LPA. The decision confirms that the person acting in the role needs to not only form an opinion as to the key elements of paragraph 2(1)(e) of Schedule 1 of the Mental Capacity Act 2005, but to also be able to evidence that opinion. The certificate provider needs to be satisfied that the donor understands the purpose and scope of authority conferred by the LPA, that there is no fraud or undue pressure on the donor, and that there is nothing else would prevent the LPA being created. Sharon Crosby, head of our Care and Capacity team comments that this case will no doubt serve as a reminder to any practitioners acting as certificate providers to ensure that attendance notes are sufficiently detailed to provide evidence of their opinion of these key elements. Guidance for non-professional certificate providers, as was the case in this instance, may also need to be reviewed to ensure that the requirements have been fully explained and understood by the person acting in that role. https://lnkd.in/gG7YQVKg
