🤔 Will consumers purchase mass-produced luxury products with no trademark? 🛍️ A new trend is emerging in #China: "trademark-free quality dupes." Chinese manufacturers are producing items that reportedly match the quality (or are made from the same materials) as high-end brands but at a fraction of the cost. 🏷️ While these products lack the 'copied' brand's trademark, they still capitalize on the goodwill of established luxury brands. These manufacturers replicate the original product's design and leverage the established brand's trademark in their marketing, drawing comparisons to promote their own offerings. 💡 Is this a clever market disruption or a step too far in product replication? Would this be covered by nominative fair use under U.S. law? ®️ Trade dress is registrable in the U.S., but requires acquired distinctiveness. Otherwise, the registration is relegated to the Supplemental Register. Trademarks listed on the Supplemental Register cannot be recorded with U.S. customs.
