Fifty years and a few months have passed since the High Court’s landmark judgment in Pilkington, which found that where two planning permissions exist in relation to the same land, both permissions cannot be implemented if they are mutually inconsistent. Pilkington was concerned with a couple of bungalows on a small-holding. Today, though, planning professionals often grapple with how best to reconcile physically incompatible permissions when securing changes to some of the country’s largest and most complex development proposals. Hogan Lovells lawyer David Wood looks at the latest development in the law and makes the case for a legislative fix.

Pleased to share my analysis of the recent decision in #Beijing Songxianghu Architectural Decoration Engineering Co Ltd v Kitty Kam [2024] HKCFI 1657, published with LexisNexis. The Hong Kong Court of First Instance addressed how confidentiality in arbitration is balanced against the need for transparency in concurrent court proceedings. ➡ The ruling indicates that while confidentiality under the Arbitration Ordinance is important, it is not absolute. The Court allowed disclosure of arbitration-related information when necessary to pursue a legal right, offering key insights for practitioners managing parallel arbitration and litigation. This decision reinforces that open justice can take precedence in cases involving serious allegations, such as fraud, emphasizing the need for transparency in the public interest.
