A non-compete clause was successfully imposed by the NSW Supreme Court in the favour of Samsung, against an ex-sales staff member. Samsung's offer to keep paying the ex-employee during the restraint period appears to have played a large role in the judgment falling in favour of the employer. This could influence the way non-compete (post-termination restraint) clauses are drafted, or defended by employers, and provides an interesting question to be framed wherever an employer is considering to pursue the non-compete. What can employers do about this? The recent Employment Appeal Tribunal case of Phoenix House Limited v. Stockman provided some helpful guidance on the issue.
