In news from the world of packaging EPR laws, CAA’s voluntary Producer registration deadline of July 1 is quickly approaching. If you are a product manufacturer, brand owner, and/or retailer, you should be taking a hard look at your product (and food service ware) offerings to determine whether you qualify as a “producer” under the different EPR laws. And if your organization has producer liability, it should be working to get its ducks in a row for the data reporting requirements under the different laws. We anticipate that this will be a heavy lift for many companies.  Below is a link to an article regarding CAA’s upcoming producer registration deadline, what this voluntary deadline means, and steps that companies should be taking right now to comply with EPR laws and prepare for required reporting under these laws. CalRecycle Director Rachel Machi Wagoner tells KCRA 3 & My58 Television that 50% of what we're sending to landfills in California is single-use #packaging. California's #PlasticPollution prevention requires that all single-use packaging and #plastic foodservice ware sold in the state be recyclable or compostable by 2032. Work is underway now to make that a reality. The director spoke to KCRA ahead of a Feb. 1 CalRecycle question-and-answer session to allow the public an opportunity to ask clarifying questions about the regulations so they can prepare comments to submit during the formal rulemaking process once that begins in the coming months. Would you like the process in your arbitrations to be more green, but don't know how to do that? The Campaign for Greener Arbitrations: The Green Pledge Green Procedural Order is a great place to start. There is no need to reinvent the wheel, or to go "full vegan", so to speak, but to pick the elements that suit your case and circumstances. Maybe you want to reduce printing and hard copies? Look at Article II. Or perhaps you prefer to hold hearings remotely in order to avoid (air) travel? Adopting the language in Articles VII-VIII will help you achieve that. My experience is that while (too) many people are not actively taking measures to make the process more environmentally friendly, very few are actively hostile to such action. So whether you are a party-appointed arbitrator or a junior on the counsel team, make the suggestion and you will be surprised how often and how willingly it is accepted.

Circular Action Alliance (CAA) has set a voluntary July 1 producer registration deadline in connection with Extended Producer Responsibility (EPR) laws, for product packaging, in California, Colorado and Oregon. In light of this, product manufacturers, brand owners and retailers should evaluate whether they are a “producer” under the different states’ EPR laws and whether they should register with CAA before CAA’s July 1 deadline. CAA is the producer responsibility organization (PRO) selected for California and Colorado and the only PRO to submit a program plan in Oregon. A PRO is the non-governmental organization responsible for implementing EPR laws.
