❓ ❔ TUESDAY Q'SDAY ❓ ❔ Today marks the first instalment of Tuesday Q'sday and we're starting off with the topic of #subletting. ❔ - I'm a #commercialtenant and have rented a unit for some time now. A good friend of mine recently started up a new business and so I offered for them to set up in a spare room in my unit as a means of helping them out. We agreed that they would contribute towards my rent in return but we didn't settle on a specific figure and nothing was formally put in writing. My friend has been in the unit a few months now and the business looks like it is going well. Should we look to formalise the arrangement? 💡 - Whilst the arrangement is seemingly going well and benefits both parties, thought needs to be given to the wider picture: 👉 Firstly, does your lease allow you to sublet part of the premises? 👉 Do you need the landlord's permission to sublet? 👉 What is your friend using the spare room for and does this fall within the permitted use in your lease? 👉 What if this arrangement put you in breach of the terms of your lease? What are the potential repercussions on you? 👉 What access/control will your friend have regarding the unit and the spare room? 👉 How long does your friend intend on using the spare room? 👉 How much rent will your friend pay, how often, to whom and how? 👉 What about the additional cost of utilities? Who will be paying for those? 👉 What happens if the friendship breaks down, your friend doesn't pay you any rent and you want them to leave but they refuse? 👉 What happens if your landlord requires you to leave and return the entire unit empty? 👉 What if your landlord is a tenant themselves and your arrangement puts them in breach of the terms of their lease? Again what are the repercussions for you? 👉 What happens if there is any damage to the spare room? Who will pay for this? These are just some of the initial questions that arise from the above scenario and why both #landlords and #tenants should always seek legal advice before committing to a #sublet. I normally view "IN" to see what others have to say. Today I am choosing to post regarding the the many fees imposed on owner/operators in my field. One fee in particular, the fire permit fee(s). Many towns and cities charge food trucks $54/year to come into their jurisdiction. They ask us for a schedule of when and where we will be in the area so they may come and inspect. I am happy to mention a few of the NJ towns/cities that I work in that only charge the annual fee. They are Glassboro, Vineland, Millville, Monroe Township, and Harrison Township. These townships do the same site inspection all the others and the state do without gouging us every time we come in to vend. The State of NJ Fire charges every single visit into a state inspected area. Winslow Township charges every 3 visits and has now imposed an expiration date on the permit of 3 months. Now let's talk about the inspection. They check my propane holding tanks, look at my hood for proper placement of suppression heads over cooking equipment, and look at my tags that show when my last hood inspection was done by a fire system company. If I move and come back 2 days later they conduct the same inspection. Obviously nothing has moved or changed in 2 days. They do not check for propane leaks with a leak detector or even a spray bottle. Most fire people walk onto my truck and don't know what they are even there to look at or where it is located. Nothing about the inspection is for "public safety". In my opinion and 9 years of experience with the State and Winslow, I will say it is about "I have the power to charge you and make money for my department so I am going to." and "We don't want your business here so we are going to fee you out of coming here." There is no regard for how much money I have to spend to do business. There is not even a concern since they do not make the topic part of their public agendas. I also have to guess they think I will just raise my prices and pass the buck, but ethically, I cannot do that. Instead, I am choosing to eliminate locations from my calendar that obviously don't want small business to survive. Speaking up at town meetings and making officials aware of small businesses is vital but it only works when they want to hear from you. Be careful who you elect. Meet them in person and talk to them. Find out where they stand on small business and public forums. It all starts at local government.
