It will also help you identify potential difficulties which may arise during the process ✓ Information on any Right of Residence that entitles a third party to live in your property. ✓ Details of any rights of way or easements that you know of, which give third parties rights over your property, or which gives you rights over other property. ✓ Details of any boundary issues or disputes with a neighbour or other third party. ✓ Any notices served on you such as Compulsory Purchase Orders or Road Widening Notices. ✓ You may need to get a Declaration of Identity. This typically applies to single houses built on their own sites but your solicitor will let you know if you need it. It certifies the title boundaries, access to the property, and the services used by the property. You will need an architect, building surveyor, geomatics surveyor, engineer or other qualified professional to visit your property to do this if it is needed. Why get a land surveyed by a licensed land surveyor in the early stages of any sort of development? We recently had a project handed to us by an engineering firm, who employed their own survey staff. This does not include a licensed land surveyor. They had the practice of providing their own proposed subdivision plan which is then signed off by a civil engineer. The property in question was subdivided in the early 1900's. Based on the original survey plan they should have been able to get two lots at 33' width. However our survey found they were short of this by a few inches. Needless to say this is not the best news to get at a PLA (preliminary layout approval) stage. In British Columbia properties are legally defined by existing monuments and or property pins found in the ground. Dimensions shown on a existing legal plan in the land title office can be subject to variations depending on age.
