South Africa’s data privacy enforcer, the Information Regulator SA has issued the first enforcement notice as a result of a direct marketing complaint. This comes at a time when the public is highly frustrated with the influx of direct #marketing messages & calls. Advocate Pansy Tlakula, chairperson of the regulator said they issued an Enforcement Notice to FT Rams #Consulting, a #training institution #business, after findings it contravened “various sections of the Protection of Personal Information Act (POPIA)”. “The regulator received a complaint from a #data subject (a person about whom the personal information relates) following countless direct marketing messages received by them. “Regardless of the multiple attempts to opt out & requests to be removed from the company emailing list, FT Rams Consulting blatantly ignored the pleas from the data subject & continued to send them marketing messages on #email,” Tlakula said. Tlakula said the regulator determined that FT Rams Consulting interfered with the protection of personal information of the data subject, & thus breached the conditions for the lawful processing of personal information. “Our leniency regarding direct marketing through unsolicited electronic #communications is going to be a thing of the past because responsible parties (public or private bodies) ignore the provisions of section 69 of POPIA & infringe on the rights of data subjects. “In response to this, we are also putting together a guidance note which will clearly spell out the dos & don’ts of processing personal information for the purposes of direct marketing by means of unsolicited electronic #communication,” said Tlakula. Tlakula said the regulator found that FT Rams Consulting had failed to adhere to POPIA & contravened sections 69 (1) & (2) a& subsequently other sections of POPIA by transmitting to the individual, without first obtaining their consent, persistent direct marketing communications through emails pertaining to the courses or webinars which it offered. “Furthermore, that although the data subject was provided with the option to ‘opt out,’ this did not remedy the situation. What an incredible learning session this week with former President Barack Obama speechwriter Terry Szuplat. #chiefofstaff Terry shared: Executive communications is a two-way street. It only works when there’s a true partnership between the speaker and the writers. 3 people have a responsibility to help make it work: 1: The Principal Comms teams are not mind readers. They can’t know what you want to say unless you tell them. Be accessible. Hold weekly meetings with your writers to discuss upcoming events and to share what you want to say. (Too busy? President Obama always made time for his speechwriters, because it was important. If the President of the United States can make time for his writers, you can too!) Let your writers sit in on important meetings. The more they hear you talk about what you believe and want in your work, the less often they’ll have to ask you what you believe and want in your presentations. Let your writers travel with you. The places you go and the people you meet will often be the best material for your next presentation or speech. 2: The Comms Team It’s your job to “capture the voice” of the principal. Read EVERY SINGLE THING the they have ever said or written: every presentation, speech, interview, article. Analyze them. Learn how how they structure and make their arguments. LISTEN to everything they’ve ever said. At the White House, Terry would go to YouTube, play an Obama speech, close his eyes, and just listen to the rhythm and cadence of his speech. Learn your principal’s voice. Welcome your their edits. The changes they make to your draft are gold—a window into their mind. Don’t ignore them. Incorporate them into your next draft. Show them you’re listening. 3: The Chief of Staff. You have a critical role in making sure this partnership works. Insist on those weekly meetings between the principal and the comms team. Make sure the principal’s scheduler knows how important these meetings are. They're not "nice to have." They're necessary. Protect them. Step back. Give your team clear deadlines. And then give them space. Let your comms team do their job—you’ll be amazed at what they can do!

I’ve made a lot of mistakes when building my brand. 1️⃣ Remember #Dear1L? Yeah, that was the hashtag I started and grew to 2,810 followers. —I started #DearLegalWriter, too. That one I grew to 1,722 followers. Then LinkedIn said ❌ to hashtags.* 👉 Lesson: Be careful building on rented land. You don’t own anything here. You should, at the very least, download your LinkedIn data regularly. Here’s how: Go to desktop —> Click on your photo —> Settings & Privacy —> Data Privacy —> How LI uses your data —> Get a copy of your data 2️⃣ My second big mistake was refusing to start a newsletter. I even drafted a whole post titled, “I hate newsletters”: In it, I explained: 🔻 I get newsletters about law school. I find them repetitive, simplistic. — “I know more than they do,” I think to myself as I read. 🔻 I get newsletters about legal writing. They’re dense, difficult to follow. — Perhaps it’s my inadequacy, but I find it taxing to extract a writing lesson from a random passage on a legal topic about which I know so little. I just end up feeling, well, inadequate. 🔻 I also find the personal tidbits in newsletters to be distracting. — “I signed up for the valuable content you create, not to keep up with whether you have a cold this week,” I found myself thinking to myself as I surveyed a sampling from my inbox this past week. And so, for 2.5 years, I refused to do a newsletter. I didn’t start until Feb 2023, and in it, I avoid the 3 things I hate about other newsletters It’s been 6 months now, and all I can say is this: 👉 PLEASE START A NEWSLETTER TODAY!!!! Benefits: —You aren’t doomed if you lack a perfect “hook.” —Your readers actually WANT to hear from you. —The Algorithm’s mood that day doesn’t matter. —There’s no risk of public rebuke. —YOU own all the data!!! —> All these make the writing process a joy, as opposed to an anxious foray outside your comfort zone. I can understand why the Information Commissioner might adopt a cautious approach to disclosures of personal data via FOI, especially if the subject is not a public official. FOI exists to hold public authorities to account, and while that might require scrutiny of individuals, regular people shouldn’t usually be the target of disclosures. But I think there are exceptions; furthermore, I think the Commissioner is currently operating a ludicrous approach to personal data. There has already been a healthy debate about their refusal to give out the email address of Uber’s DPO (a silly refusal in my opinion). But the one I am highlighting today is arguably worse. Uber have a generic DPO email address, so it’s at least arguable that disclosure of the identifiable version isn’t ‘necessary’, although the DPO in question isn’t exactly operating undercover. Today’s example relates to FOI training materials used by the ICO for its own staff, which include examples of real requests. That means the materials include “the name, username, profile photo and request made by individuals who have wrote to the ICO via social media to make a FOI request”. If you want to accuse me of being a grammar snob for the face that sentence is making me pull, go right ahead, because I am gurning as if headed for Egremont Crab Fair. Google it. I think organisations should be protective of FOI applicants’ identities – you have to walk a fine line if there’s a possibility of vexatious or costly requests, but in general, the best way to ensure that a request gets an applicant blind response is not to tell the information holder who the applicant is. But all of that goes out of the window if you make your request on social media or via What Do They Know. Applicants have a clear choice – make your requests direct (which I nearly always do) and enjoy the benefits of relative anonymity, or incorporate an element of performance into it and expect to be identified. It’s just possible that the way in which the examples are used reflects some additional data about the applicants, but the Commissioner’s response doesn’t say so. The reply is simply that despite the fact that requests were made in the public domain, it would be unfair to identify the applicant. I am bemused. Befuddled. Bamboozled. The applicant has complained to the Commissioner in their capacity as regulator and while successive Commissioners have a long track record of endorsing their own decisions, this must be worth a roll of the dice: https://lnkd.in/exgbHNh9
