Claims management companies actively seek out and create complaints directly targeting advice firms. How do you protect yourself? Step three… 3. A client file full of contemporaneous notes, observations and, of course, the paperwork is an adviser’s best friend when a client or claims company raise a complaint. Soft facts are always important but do not overlook including options or research you considered and ultimately rejected before arriving at your recommendation. We have recently defended an adviser over advice given in 2004. The file was near perfect, containing all the research (used and unused), confirmation all the relevant processes were followed and signed client acceptance of the advice and the basis on which it was given.
