What Right Do You Have On Probation? When you’re on probation, your rights are extremely limited. The probation officer has significant control over your actions and can report any non-compliance to a judge. To stay out of trouble: - Be proactive: Regularly update your probation officer about where you live, your job status, and your compliance with probation terms. - Stay in touch: Weekly calls or texts to confirm everything is fine can prevent unexpected visits or searches. If you stop communicating, that’s when issues arise. Probation officers don’t need a warrant to check on you if they suspect you’re not following the rules. Violation of Probation Hearing Outcomes 🚨⚖️ At LAR Legal Group, we know how stressful a Violation of Probation (VOP) hearing can be. Here are the 3 possible outcomes: 1. Reinstating Probation 🔄: For minor violations, the judge might let you continue with the same probation terms. 2. Modifying Probation ⚙️: If the violation is moderate, new conditions like drug treatment or anger management might be added, or reporting requirements could change. 3. The probation officer will interview you and conduct their investigation. But if you have taken the time to write a heartfelt narrative that you provided along with everything else they requested 1-2 weeks before your interview, they may have the time to get to know who You are. If all goes right, they may come away from the meeting with a feeling of a person that is the opposite of the Indictment they have been reading when they recommend your sentence to the Judge. No Promises, but yes! That’s why it is very helpful to be prepared, and included in this preparation is a well-written, introspective, heartfelt personal narrative. https://lnkd.in/eDPDv7mW Judges understand that crimes don’t happen in a vacuum; they want to know what happened in your life that caused you to do this. No excuses. Accept responsibility while having remorse for the victims harmed. If you’re lucky, this may prompt the judge to converse with you at sentencing, where you can speak from the heart, covering the points in the narrative. No witness tampering. Hopefully, you have been working, volunteering, or caring for a disabled or sick relative in the time period before sentencing because judges don’t want to learn that you’ve been doing nothing but sitting at home. If you have multiple cars and houses, sell them if you’re facing a financial penalty (i.e., restitution) But with no narrative, then the DOJ has written your story for you in the form of your INDICTMENT, and the judge will use that to sentence you. · This makes the PSR much more critical than the sentencing memorandum. Probation Officers are: · overworked and have no time, with some appreciating counsel’s effort in getting everything they’ve requested to them organized and early. They can now take their time filling out their Probation Report Worksheet. Then, on the day of the interview, they’ll have the time to personally get to know you and ask any remaining questions they may have. · At the end of their meeting, the Probation Officer may feel that the defendant took this seriously, leaving them with a more positive view of your client, other than the person referenced in their Indictment." a) It provides information about the offense for which the defendant is being sentenced, b) Acceptance of Responsibility and c) Victim Remorse statement, d) Release Plan, e) and where the sentencing guidelines apply. · This includes background information about the defendant, such as · criminal history, education, work experience, family background, and health history, f) A Realistic Sentence Recommendation and BOP Placement Request Should Be Included To engage my services or to have your concerns answered, Call me Today: 240.888.7778.
