#Interview | Alex de Wet, Director in Real Estate joined Simon Brown at Moneyweb where he discussed Legalities around landlords, tenants, and rental agreements. Alex says that numerous pieces of legislation deal with rental accommodation, but the most prominent ones are probably the Rental Housing Act, which was amended quite recently, and the Consumer Protection Act, which provides a lot of protection specifically for tenants and imposes various obligations on landlords as well. Alex adds that the biggest mistake parties make is not understanding their rights and obligations under the contract. Having a sound contract is probably the most important issue, as it forms the foundation of the relationship between the two parties and regulates how they effectively implement that relationship, including what the landlord can expect from the tenant. However, Alex says that the most crucial element of the rental agreement is the exit clause, which ensures that a tenant is not stuck in an unsatisfactory agreement. This applies to landlords as well. For example, legislation like the Consumer Protection Act provides rulings on fixed-term contracts, statutory notices, and penalties if you terminate within the term. But at least the legislature has created an environment where the tenant has a bit more protection from the landlord. "#RealPage’s software, including its #YieldStar product, is used by landlords to estimate supply and demand for their listings, allowing them to maximize rents. The Richardson, Texas-based company employs statistical models and nonpublic data, much of it submitted by its property management clients, to make its estimates. Fairer private renting 🤝🏡 The Renters (Reform) Bill is one of the most significant pieces of legislation for private renters and landlords in the past 30 years. At the end of April, it went through its third reading in the House of Commons. The government has said it will delay the ban on Section 21 evictions to relieve pressures on court time. However there are also many other significant proposals that affect tenants, letting agents, and landlords. The bill also incorporates the transition to rolling tenancies, introduces new guidelines allowing tenants to have pets, establishes England's first landlord ombudsman, and introduces a new property portal. The Conservative Party has committed to passing the bill into law before the date of the next General Election, which is widely anticipated to take place in the Autumn of 2024. "The U.S. Department of Justice is gearing up to challenge what it says is collusive conduct in the #rental #housing market with a lawsuit against a software company that it believes allows large landlords to fix prices. The DOJ is planning to sue RealPage, Inc., a software company used by landlords across the country... DOJ staff recently recommended a civil lawsuit against RealPage that would accuse the company of selling software that enables landlords to illegally share confidential pricing information in order to collude on setting rents... Also on the table for a complaint is the landlords’ ability to use the software to match vacancy rates, essentially restricting supply, at competing buildings in the same rental market...
