Breaking News (18 September): In a split 3:2 decision, the New Zealand Supreme Court upholds the High Court and Court of Appeal decisions, confirming that the 10-year longstop in s393 of the Building Act does not apply to contribution claims under the Law Reform Act 1936 and the Limitation Act 2010. Key Takeaway: Tortfeasors have two years after a liability finding to bring contribution claims against other parties. Building industry participants cannot relax after the 10-year longstop has passed. All industry players should stay vigilant about the possibility of ongoing litigation on historic projects and reassess their risk and insurance coverage in light of this ruling. #SupremeCourt #ConstructionLaw
