Under international human rights law, police officers are obligated to respect the dignity and rights of all individuals. Assaulting citizens or imprisoning individuals without charge is a violation of these principles and is prohibited under multiple legal frameworks. Article 5 of the Universal Declaration of Human Rights (UDHR) states that “No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.” Similarly, Article 9 of the UDHR asserts that “No one shall be subjected to arbitrary arrest, detention, or exile.” These provisions collectively highlight that law enforcement officials must not use excessive force or detain individuals without lawful justification or due process. Furthermore, the International Covenant on Civil and Political Rights (ICCPR), which is legally binding for its state parties, reinforces this stance. Article 7 prohibits torture or cruel, inhuman, or degrading treatment, while Article 9 emphasizes the right to liberty and security of person, including protection from arbitrary arrest or detention. National laws in many countries echo these international standards, with constitutional provisions and police codes of conduct outlining strict protocols against abuse of power. For example, in the United States, the Fourth and Fifth Amendments safeguard individuals against unlawful detention and abuse, while similar protections exist under the Police and Criminal Evidence Act 1984 (PACE) in the United Kingdom. Imagine a law that makes it illegal for politicians to lie. Sounds far-fetched? The Welsh government is taking steps to make this a reality. A recent Guardian article cites a barrister for one of the Welsh MPs: "Truth-telling is essential to democracy. As voters, we should be entitled to rely on the statements made by our elected representatives. This measure will ensure that politicians are held to the same standards as lawyers and doctors, who already have enforceable truth-telling obligations." The Human Rights Act 1998 is a law in the United Kingdom that incorporates the rights and freedoms defined in the European Convention on Human Rights into UK law. Breaches of the Human Rights Act 1998 occur when individuals or authorities violate the rights and freedoms protected under the Act. Some common examples of breaches of the Human Rights Act 1998 include: 1. Violation of the right to life: This includes unlawful killings, failure to protect individuals from harm, and actions that put someone's life at risk without justification. 2. Violation of the right to liberty and security: This includes unlawful detention, arbitrary arrest, and detention without a fair trial. 3. Violation of the right to freedom of expression: This includes censorship, restrictions on peaceful protests, and discrimination against certain views or opinions. 4. Violation of the right to privacy: This includes unwarranted surveillance, intrusion into private communications, and disclosure of personal information without consent. 5. Violation of the right to a fair trial: This includes denial of legal representation, unfair or biased judicial proceedings, and excessive delays in the justice system. When a breach of the Human Rights Act 1998 occurs, individuals affected can seek redress through domestic courts or by bringing a case to the European Court of Human Rights.
