Is your firm TA6 ready? With the new TA6 form set to roll out for all CQS firms in June, with further firms to follow shortly after, how will your practise deal with the additional support likely required for both clients and junior fee earners? Never before has it been more important to employ experienced lawyers. Is this an attempt by the SRA to even out the level of fee earning experience across our industry? It feels like something underlines this decision by the SRA as it will likely prove to be a further hurdle/delay in a process that has increasingly become overly strung out over the years. What are the SRA thinking, who makes these decisions, certainly not experienced fee earners.

A father was apprehended for sitting the UTME exam on behalf of his son. A father was arrested for impersonating his son during the 2024 UTME exam, highlighting ongoing issues of cheating and impersonation. The JAMB Registrar emphasized the consequences of such actions, noting improved technology aiding in detection. Despite challenges like dual NINs, efforts are underway to address identity verification loopholes. He praised smoother exam procedures due to enhanced automation, with over 1.94 million candidates participating. Concerns arose over parental interference, although minimal compared to previous years. Candidates missing exams due to logistical issues faced challenges, with JAMB unable to accommodate rescheduling for a few. The Registrar criticized schools exploiting students for profit, leading to exam disruptions. Efforts continue to maintain exam integrity and streamline procedures for future UTME sessions.

Rule 7004(h) - Service on an FDIC institution The issue of a credit union being considered as an FDIC institution is no longer an issue! For years, I have been counseling attorneys who have questions about serving credit unions to follow Rule 7004(h). The rationale being that there was a split of authority on whether they are actually considered to be an FDIC institution. See In Re Drobney, 583 B.R. 700, 702 (Bankr. W.D. Mich. 2018), In Re Fisher, 2008 WL 4200388, (Bankr. N.D. Ala. Sept 12, 2008), and In Re Cornejo, 2010 WL 7892449, 1 (Bankr. D. Alaska Aug 2, 2010). The best approach then was to simply mail the notice pursuant to Rule 7004(h) and avoid the controversy altogether. The cost of mailing a document via certified mail clearly was cheaper than having to go to court and defend the service as not being sufficient. This is no longer necessary for claims objections. In 2021, Rule 3007(a)(2)(A)(ii) was amended to clarify that claims objections are required to be served under Rule 7004(h) only "if the objection is to a claim of an insured depository institution as defined in section 3 of the Federal Deposit Insurance Act." Fed. R. Bankr. P. 3007(a)(2)(A)(ii)(2022). It is permissible to serve a claim objection via regular first class mail, pursuant to Rule 7004(b)(3) - service upon a domestic or foreign corporation. However, please be sure to make your service to the attention of an officer, a managing or general agent, or to any other agent authorixed by appointment or by law to receive service of process. See Fed. R. Bankr. P. 7004(b)(3). A big shout out to Bobby Wilbert, who posted an opinion yesterday from Judge Delano, out of the Fort Myers Division for the Middle District of Florida. Working for BPEC, a small, specialist Awarding Organisation, I wholeheartedly support the DfE's decision to pause the post-16 qualifications reform and the defunding of Level 3 technical qualifications, pending a review. Hopefully, the new review will recognise the value of diverse educational pathways, allowing students to pursue technical skills essential for their future careers. Smaller Awarding Organisations like ours can continue providing high-quality, specialised qualifications that meet industry needs. Creating monopolies and restricting choice will inevitably lead to reduced competition, which diminishes customer service, quality, innovation, and overall added value. As evidenced by recent regulatory actions from Ofqual, bigger isn't always better. It's crucial to maintain a diverse and competitive educational landscape to ensure the highest standards in delivery, quality, and service. This diversity fosters innovation and responsiveness, benefiting all stakeholders involved.
