I’ve been looking at the numbers and I wonder whether the current deputyship application process is both ableist and discriminatory. For people with capacity, the process for Lasting Power of Attorney isn’t cheap but it is likely to be successful with only 2.4% of applications being rejected. For those who are most at risk – the small percentage of people who do not have capacity to apply for LPA – their loved ones go through the process of deputyship as there is no alternative process to enable them to be recognised by services as advocates and voices for their loved ones. But the Court of Protection rejects between 38 and over 70% of deputyship applications. So those people who require the greatest safeguarding measures (identified in CIPOLD, 2013 as having a person who loves them in their network advocating for them) are put at further risk by preventing them from having a key voice from someone who knows their context, aspirations and needs – doesn’t work 9-5, doesn’t have annual leave and doesn’t change role. Looking at any of the preventable death case reviews in recent years, communication, collaboration and a lack of understanding around the Mental Capacity Act frequently impacts the health and welfare of people with a learning disability. I'm looking for some support around referral pathways for Children/Young people who engage in Harmful Sexualised Behaviours and have an intellectual disability and are Autistic (in Victoria). I'm referred many children, who do not meet clinical threshold for Sexually Abusive Behaviour Treatment Services (SABTS). Or as a result of their level of disability are not being accepted by HSB services, and it's in turn being put on NDIS providers. But are enaging in behaviours that I do not personally feel I can provide appropriate service to (due to clinical risk, and need for proper assessment of behaviours that are potentially forensic or at risk of becoming forensic without appropriate support) . So, what I'm after is a list of specialist behavior practitioners/orgs with expertise in children with neurodevelopmental disability who display (HSB/red zone level of HSB). If I can't take on cases, I want to provide a helpful referral pathway for more complex presentations. Thanks! #harmfulsexualbehaviour #HSB #NDIS #servicegap #MDT
