Finished the course the “Frye, Daubert, and PCAST: Countering Admissibility Challenges” from Forensic Technology Center of Excellence – Awarded by the National Institute of Justice, Office of Justice Programs, U.S. Department of Justice. The webinar “Frye, Daubert, and PCAST: Countering Admissibility Challenges” provided an in-depth look at the evolution of standards for the admissibility of scientific evidence in court. This training was presented as a part of the National Center on Forensics. In this session, a panel of experts review the evolution of Frye and the progression to Daubert regarding standards of admissibility, and the publication of the 2016 PCAST report. This discussion highlights the pros and cons of the Frye Standard vs the Daubert Standard, the PCAST Report standards to be used in forensic investigations with specific examples, and countering PCAST admissibility challenges in Daubert cases.

This will be a very interesting CPD session delivered by Jessica Cannon. Don’t miss it! When I first started my career in strata law, I formed a habit of reviewing all recent adjudication decisions each week. Everyone procrastinates at their desk from time to time, and that’s how I have done it for many years (and I still do it!). It’s interesting to see the disputes that arise and how adjudicators resolve them. You get a sense of the personal style adjudicators have. It widens your experience when you read what other schemes have gone through. One of the cases Jessica will delve into involves a dispute about whether a body corporate could exercise its statutory power to have contractors regularly enter a unit to abseil from its balcony for a project that would take a year. Is such lengthy and intrusive entry reasonably necessary for the works that have to be done? Can an owner or occupier push back on that?

https://lnkd.in/gSpyNKua The level of nonsense pseudo-legal analysis is stunning. It essentially runs thus, “This special counsel is not valid, because I just don’t think so. And all the laws that provide for the existence of such a person — don’t worry about those. I read them, and I just don’t agree. So the case is over.” Bear in mind, the documents in this case were among the most sensitive and highly classified documents which bear such classifications. Among these documents were several bearing the stamp, “SCI.” “Sensitive compartmented information.” Those could have been plans for the infrastructure required for future wars with enemy nations, plans which required extensive knowledge, expertise, and intelligence. These documents threatened national security. And they were just sitting around, in bathrooms, in hallways, and even on the stage of some kind of ballroom in Mar-a-Lago, with no regard for the sensitivity of the information contained within, retained well beyond the duration of the term of the presidency, and in violation of law. Furthermore, the defendant even lied about returning all of the documents. #classifieddocuments #classified #topsecret #sensitivecompartmentedinformation #sci
