#15 Understanding The Influence of Contracts Ask your PM how your project is contracting and incentivising (head contract + subcontractors) ie fixed price, unit rate, cost+ etc Then next time you encounter inefficiencies on site eg a subcontractor doesn’t want to work on an available workfront you want them to —> Refer to contracting model above. It’s important for everyone on a project to understanding that ‘best for project’ outcomes will be misaligned by different motivations driven from contracts. Understanding this will potentially lead people to being less frustrated (less stress) by knowing the reality of the situation. But also on the next project potentially pressing for alternative forms of contracting that can better align to ‘best for project’ outcomes. This tip is about reducing frustration by increasing understanding and perspective, and potentially decrease the broader industry dependence on fixed priced contracting (up and down the chain).

I've definitely learnt from professionals in the industry, that the foundation of first-adoption to a new contract type is 𝗠𝗜𝗡𝗗𝗦𝗘𝗧 🧠 I've heard how this hasn't gone so well - usually where one of two parties isn't necessarily 'on board', or pulling their weight when it comes to this... If the requirements around the contract aren't followed, but nothing bad has happened 𝒚𝒆𝒕, then we're really just delaying the inevitable... But I've also seen examples of clients and contractors doing an awesome job of it first time. 💡 I don't want to preach TP CONTRACTS (CEMAR) to the heavens, but it's usually the case that that helping hand SIGNIFICANTLY helps first-time NECers and the likes. That initial step is made A LOT simpler and A LOT less stressful for both parties... 1. Imagine moving to a new contract type, and all of the templates for the contractual communications, are pre-built and automatically populated... 2. Imagine all of the clause reference numbers are automated on those contractual communications - erasing any human error... 3. Imagine when you raise an NEC compensation event, the CE PMI, CE notification & QTE PMI are autogenerated and communicated to the relevant party in one click - AND automatically linked through 'associations' in the system... There's a lot more to list, that's for sure, but it makes things a lot easier for you right?
