💤 𝘿𝙄𝘿 𝙔𝙊𝙐𝙍 𝘿𝙀𝙇𝙄𝙑𝙀𝙍𝙔 𝘿𝙍𝙄𝙑𝙀𝙍 𝙂𝙀𝙏 𝙀𝙉𝙊𝙐𝙂𝙃 𝙎𝙇𝙀𝙀𝙋? 💤 Hours of Service (HOS) regulations are critical in trucking accident cases as they directly impact driver fatigue, a common factor contributing to accidents. These regulations, enforced by the Federal Motor Carrier Safety Administration (FMCSA), are designed to prevent accidents by limiting how long truck drivers can operate without taking breaks or resting. Under HOS rules, property-carrying drivers must adhere to a limit of 11 hours of driving following ten consecutive hours off duty. Drivers must also take a 30-minute break if more than eight consecutive hours have passed since their last off-duty or sleeper-berth period. Furthermore, the regulations stipulate a 14-hour window in which these 11 hours of driving must be completed, after which drivers must be off duty for ten consecutive hours. For the weekly limits, drivers cannot exceed 60 hours on duty over seven consecutive days or 70 hours over eight days. Compliance with HOS regulations is a pivotal area of investigation in trucking accident litigation. Non-compliance can be a significant factor in establishing negligence. However, many trucking companies go to great lengths to “lose” key evidence—employing tactics to pay you as little as possible, discredit your injuries, or even shift the blame onto you. But, in our experience, trucking companies will stop at nothing to exploit legal loopholes or employ delaying tactics in order to avoid responsibility after a truck accident.
