Claims and Litigation Management’s Claims College is right around the corner! Created in 2007, Claims College was created to meet the professional needs of claims and litigation professionals; specifically, allowing students to work towards earning their Certified Claims Professional (CCP) and Advanced Claims Professional (ACP) designations. This year, Angela Kopet, Lee Weatherly, and Kristen Thompson are headed to Austin, Texas and will be teaching classes in the School of Casualty Claims and School of Leadership. Angela is also Dean of the School of Leadership with Fausto Martin. Attendees earn CE/CLE credits, learn from industry professionals with real-world experience, and work towards a professional designation. Class certification is the most important moment of any putative class action. Before class certification, the defendant’s exposure beyond the individual claim is still theoretical rather than concrete. However, certification of a class allows a single plaintiff (or a small group of plaintiffs) to formally pursue the claims of numerous absent individuals, which raises the stakes for defendants. Great overview by my partners of considerations for defending motions for class certification. I think they have hit the nail on the head in terms of outlining high-level considerations. Like our other Class Action 101 posts, this provides a great starting point for in-house counsel or business personnel to get a sense for big picture issues they can raise in discussion with their outside counsel, and also for outside defense counsel looking for a refresher on how to approach class certification that can help guide their strategic planning in particular cases.
