Just imagine....📡 You're sitting on the couch, on a great sunny afternoon, your kids frolicking around and you wondering what to do. You decide to watch a movie... If you had to decide between "May the Force, be with you" - #StarWars or "#Aftertheapocalypse" which one, would you choose? The war between #Fiction v. #Facts... The war does not limit itself to the boundaries of your TV but underlines the thin lines of the #Copyright law in #Canada. Do you sometimes use examples to explain facts? Well, this might be an interesting read for you. Read on. In the case of Winkler v. Hendley 2021 FC 498, the Hon'ble Federal Court highlighted the significance of separating facts from fiction when sharing real-life events. We usually see in Hollywood and Bollywood movies, that although the movie may be based on real-life incidents and represents some facts, there is a presence of fiction as well. The court in this case, rejected the plaintiff's position stating that "An author who publishes what is said to be a nonfiction historical account cannot claim that it is actually fictional to avoid the principle that there is no #copyright in facts" (para. 4). On March 22, the #News/ #Media #Alliance joined an amicus brief in support of #Hachette in Hachette Book Group, Inc. v. #InternetArchive, concerning Internet Archive’s digitizing of #copyright #protected books and the making those books available to the public for free without authorization. The district court found in favor of the book publishers and the case is currently on appeal to the Court of Appeals for the Second Circuit. The amicus brief emphasizes the purpose of #copyright as an incentive for creative effort and notes that #owning “#oneCopy of a #copyrighted work does not entitle the owner of that copy to make and distribute additional copies.” While Internet Archive claims that its digitization project is making it easier for libraries to lend books to their patrons, book #publishers already #license their works to the libraries. The brief goes on to argue that #digitizing physical media and #lending it online is not fair use, Internet Archive’s use is not “transformative,” such use negatively affects the existing licensing market, and that adopting Internet Archive’s theory of fair use would have devastating consequences for the >> music, >> movie, and >> publishing industries. The other organizations in the brief included the Recording Industry Association of America (RIAA), the National Music Publishers’ Association (NMPA), and the Motion Picture Association (MPA).
