My column this month in The Legal Intelligencer's #Pennsylvania Law Weekly reports on the discussion at this year's #EnvironmentalLaw Forum about the implications of #RuleofProfessionalConduct 1.1 (#competence) in a world experiencing #climatechange specifically for environmental practice. The general issue was raised by John Dernbach at the 2023 ELF and then in an article in University of Missouri-Kansas City L. Rev. by Irma Russell, John, and Matt Bogoshian. The Supreme Court of the United States’ recent ruling in Loper Bright Enterprises v. Raimondo dealt a significant blow to the power of federal agencies by ending the 40-year-old precedent commonly known as “Chevron deference.” Loper has now removed the judicial mandate that courts apply “Chevron deference” and defer to agencies on the interpretation of ambiguous language in laws pertaining to their authority. While it is unclear what impact this ruling will have in environmental enforcement cases as well as environmental regulations, federal judges will now have the power to decide what a law means for themselves, expanding the federal bench’s role in enforcement actions and policymaking. #LoperBrightRuling #ChevronDeferenceOverturned #environmentrules

This episode focuses on the recent U.S. Supreme Court decision in Loper Bright Enterprises, Inc. v. Raimondo and its impact on administrative and environmental law. The discussion features Professor Lisa Heinzerling of Georgetown University Law Center, a leading scholar in environmental and administrative law, and John Cruden, a Principal at Beveridge & Diamond PC and former Assistant Attorney General for the Department of Justice's Environment and Natural Resources Division. The panel examines the court’s 6-3 ruling, which overturned the long-standing Chevron doctrine, shifting the power of statutory interpretation from agencies to judges, now requiring judges to determine the "best interpretation" of ambiguous laws. Heinzerling provides context on the Chevron doctrine’s 40-year application and potential alternatives, while Cruden discusses the implications for future cases from a private lawyer’s perspective. Together, they explore the broader effects on administrative agencies, environmental policy, and statutory interpretation.
