⚖️ Justice for Tbilisi residents affected by power plant pollution Residents of an apartment block in central Tbilisi complained to the local authorities about toxic fumes from a thermal power plant just metres from their homes. Doctors thought their illnesses could have been caused by the fumes. The Georgian courts were not satisfied with this evidence and dismissed the claims. At the time, such dangerous industrial activities were effectively left in a legal vacuum. The European Court of Human Rights in Strasbourg ruled that this had violated the applicants’ right to #PrivateLife (Article 8). ➡️ As a result, Georgia took steps to improve environmental protections. 🚨 The Ministry of Water and Environment (Uganda) intends to come up with the Extended Production Responsibility Act which is intended to help in curbing the pollution of Lake Victoria. Per the communication, upon enactment of this Act the manufacturer of a product that generates waste should be able to trace the whole cycle of waste that they produce and it will be their responsibility to collect that waste from the environment. #environmentallaw

🌍 A recent eye-opener for me has been learning about the climate litigation in India! In the light of ongoing Ladakh protests, I learnt about the role of legal activism. Many precedents exist where common citizens have held governments accountable for climate action. A young activist Ridhima Pandey challenged the government's inaction on climate change in 2017. The 'polluter pays' principle that is a commonly understood environmental protection measure to hold polluters responsible today has also been a response to litigation by Indian Council for Enviro-Legal Action (ICELA) in 1996. In 2018, Ashish Kumar Garg challenged the environmental clearance granted to a hydroelectric power project in Uttarakhand. The instances of devastating projects and development prerogatives will continue to increase in the years to come. Our fragile ecosystems need interventions of different kinds to be protected. I hope each of us finds a way to engage in #ClimateAction through any lever that works for us. In the recent Lok Sabha elections, environmental issues were largely ignored by political parties, as pointed out by historian Sugata Bose. Speaking at the 50th anniversary of the State Pollution Control Board, he emphasized the need for social movements to pressure the government on climate change. He criticized political parties for neglecting environmental concerns that affect both current and future generations. This view was significant as top state officials, including the Environment Minister, were present at the event. The Narmada Bachao Andolan vs Union of India (2000) and A.P. Pollution Control Board vs Professor M.V. Naidu (2001) judgments marked a significant shift in the Indian judiciary's approach to environmental jurisprudence. These rulings recognized the right to water as a fundamental part of the Right to Life under Article 21 of the Indian Constitution, emphasizing the state's duty to ensure access to clean and safe water. In the Narmada Bachao Andolan case, the Supreme Court highlighted the intrinsic link between water and life while addressing environmental and human rights concerns related to large dam projects. This judgment broadened the interpretation of Article 21, associating the right to a dignified life with environmental conservation. The subsequent judgment in AP Pollution Control Board vs Professor MV Naidu further reinforced the state's obligation to provide clean drinking water, explicitly acknowledging water quality as a critical aspect of the fundamental right to water. These legal developments expanded the scope of Article 21, integrating the right to a healthy environment and clean water within the ambit of enforceable fundamental rights. However, the enforcement of these rights is challenging. India, with 18% of the world's population and only 4% of its water resources, faces a severe water crisis. Issues like over-extraction, pollution, and inefficient water management practices exacerbate the situation. The discrepancy between judicial pronouncements and their practical implementation is stark, marred by weak enforcement mechanisms, bureaucratic delays, and inadequate infrastructure. In essence, while the Supreme Court's judgments have laid a strong legal foundation for the right to water, realizing this right demands more than judicial recognition. It requires a holistic approach, encompassing legal reforms, efficient water management, and a collective commitment to sustainable practices. The critical need to protect Namibia’s environment while enabling its socio-economic development By Marco Raffinetti Namibia is one of the few countries in the world where protection of the environment is enshrined in its highest law, the Constitution. This clear indicator shows how seriously the Government of the Republic of Namibia (GRN) takes preservation of its natural environment.
