UPCOMING CLE - DIRECT AND FURTHER APPELLATE REVIEW IN THE Supreme Judicial Court: Why, When, and How to Apply; What to Expect Join the Social Law Library and our outstanding faculty including Supreme Judicial Court Justice, Dalila Wendlandt; Jessica Barnett, Chief Staff Counsel to the Justices, Supreme Judicial Court; Maura Looney, Assistant Clerk, Supreme Judicial Court for the Commonwealth; and attorney Neal Quenzer, Wilmer Cutler Pickering Hale and Dorr, LLP as they discuss how the best appellate attorneys in Massachusetts do more than file good briefs and argue their cases well. They also consider which of the two appellate courts is better suited to hear and decide their appeals. They know how to assess their options and strategize, both before and after an appeal has been decided, if they wish to move their case from the Appeals Court into the Supreme Judicial Court. This program focuses on the SJC’s selection of its cases from the Appeals Court’s docket; how the direct and further appellate review processes work from the court’s perspective; what the court looks for when selecting cases at the different stages; and how counsel can best position their cases in our two-court appellate system. No doubt...law schools teach from court opinions through the Supreme Court where precedence and legal reasoning based on at least reasonable interpretations of precedent and legal analysis of Constitutional history. But this Court has shown that precedent, reasonable readings of statute and history can be ignored or twisted into pre-determined decisions. So, what values and legal thinking can be offered from this Court? https://lnkd.in/eYxeBERq

Appellate attorney | Embedded appellate counsel for trial litigation | California and Ninth Circuit appeals | Legal writing enthusiast
Talk about impressive. I recently served as a moot court judge twice. Once for a national moot court competition, and then for an appellate advocacy class. Both at my law school, Pepperdine Caruso Law. The students were excellent! The skillsets for excelling at moot court and in a real courtroom are not identical. But there is a lot of overlap. A few difficult skills I saw on display: ✔ Disagreeing respectfully (without robotically saying "respectfully" each time) ✔ Answering a yes or no question with a "yes" or "no" before elaborating. ✔ Knowing what you can concede and when it's okay to have less than 100% certainty. Based on what I saw as a moot court judge, several future clients will be in good hands when these students are representing them in court.

As the Supreme Court concludes its term, the importance of varied perspectives in our highest courts is more evident than ever. The decisions made in our courts impact everyone, and to ensure justice is truly served, it’s vital that the arguments presented reflect a wide range of experiences. Exposing all law students to appellate law and facilitating interactions with appellate judges, clerks, and practicing attorneys is crucial for fostering a judiciary representing all Americans. Today, we’re sharing a powerful testimonial from two of our mentees who attended a recent courthouse visit and engaged with the judges and clerks. This experience was transformative, highlighting the importance of accessibility and broad representation in the legal profession. Your support can help us provide more students with these invaluable opportunities: 👉 👉 👉 https://lnkd.in/ddAdMJC Together, we can nurture a new generation of lawyers and judges who truly represent and serve all Americans. #AppellateLinkedIn #representationmatters
