Last week I organized a Tax Day for CWS Winchester. After discussing with my colleagues, I realized that there were client concerns and questions about filing taxes. I recruited a CPA who volunteered her workday to file taxes for multiple clients. Clients not only filed their taxes but also had a mini lesson in financial literacy. We were able to provide a safe space for asking questions and relieving any concerns that they had as first-time tax filers. #refugeeempowerment #selfsufficiency

Dear Friends, Family, Neighbors, I hope this message finds you well. I want to take a moment to discuss an important aspect of managing your taxes: the significance of filing your tax returns on time, even if you are unable to pay the full balance due immediately. Filing your tax return by the due date is crucial for several reasons. Firstly, it helps you avoid the late filing penalty, which can significantly increase the total amount you owe. The IRS imposes a failure-to-file penalty, which is typically 5% of the unpaid taxes for each month or part of a month that a tax return is late. This penalty starts accruing the day after the tax filing due date and can go up to as much as 25% of your unpaid taxes. Moreover, timely filing allows you to limit the interest charges on any unpaid tax. Interest is charged on taxes not paid by the due date, even if you have an extension to file. This interest compounds daily from the due date of the return until the date you pay in full. Additionally, filing your return on time, even if you cannot pay in full, opens up various payment options offered by the IRS. These include installment agreements and offers in compromise, which can make it easier to manage your tax liability without putting undue financial strain on yourself or your business. It's also important to note that if you are due a refund, there is no penalty for filing a late return. However, you must file your return within three years of the due date to claim your refund. After this period, any unclaimed refunds become the property of the U.S. Treasury. In summary, filing your tax return on time is a critical step in managing your tax obligations responsibly. It helps minimize penalties and interest, provides access to payment options for outstanding balances, and ensures you receive any refunds due. I am concerned that amending the law would 'lock in' the IRS's nullifications of the original law, and harm cases currently under appeal. I would be happy to be persuaded otherwise. Further, the proposed legislation would leave key nullifications in place. I have just published How Shands Can Save the Tax Whistleblower Law. It explains, step by step, how the D.C. Circuit could largely undo the worst IRS nullifications by reversing the Tax Court decision in Thomas Shands v. Comm'r and remanding with instructions for further proceedings. The article was released in two installments, both of which are accessible by Tax Notes subscribers. I have posted today a PDF of the first installment.
National Whistleblower Center sent a letter urging Congress to include the IRS Whistleblower Program Improvement Act as a part of the Tax Relief for American Families and Workers Act of 2024. “Despite returning billions of dollars to the pockets of American taxpayers, IRS whistleblowers continue to face unnecessary hurdles that would be addressed by the bill,” NWC’s letter states. “An IRS report revealed that the average time to process a whistleblower case is over 11 years. These debilitating delays undermine the efficacy of the IRS program.”
