The Occupational Safety and Health Administration (OSHA) has proposed a new rule aimed at preventing heat-related illnesses and injuries in the workplace. This ruling has garnered various responses from the construction industry and other stakeholders. Construction Industry Response: The response from the construction industry has been mixed. Many stakeholders acknowledge the necessity of such measures due to the significant risks posed by heat-related illnesses. From 2011 to 2022, there were 479 fatalities and nearly 34,000 heat-related injuries and illnesses reported, emphasizing the need for stringent protections (SlateSafety - Safety Connected) (GTM). However, there are concerns about the feasibility and practicality of implementing these measures, particularly for smaller businesses and those in high-risk sectors like agriculture and construction. The requirement for mandatory breaks, provision of shaded or air-conditioned rest areas, and detailed acclimatization plans may pose logistical and financial challenges for some employers (Fisher Phillips) (GTM). Additionally, the proposed rule will undergo a 120-day comment period and public hearings before finalization, during which employers and other stakeholders can provide feedback. The rule is expected to face legal challenges and potential delays, especially if there is a change in executive leadership or judicial rulings that impact federal agency regulations (Fisher Phillips). Preparing for Compliance: Employers are advised to start preparing for the proposed changes by identifying heat hazards, developing and updating heat safety policies, and training employees and supervisors on heat safety measures. Proactive steps now can help ensure compliance once the rule is finalized (Fisher Phillips) (GTM). Overall, the construction industry is gearing up for significant adjustments to enhance worker safety under extreme heat conditions while balancing the practical challenges of implementing the new standards. Occupational health and safety (OHS) has a long history (relatively speaking), and it's useful to take the time every now and then to see where we once were and remark on the social progress that has been made. Yes, things are not perfect today and lots of changes are needed, somewhat in part due to rising quality of work/life expectations (this is a good thing). However, we still have made great strides in terms of protecting people at work and those affected by work. Over the past ~150 years in much of the world*, we've seen: - The introduction of the safety management as an organizational activity. - Commonplace safety controls like machine guards, training, personal protective equipment (PPE), fatigue management, and many other things. - The creation of workers' compensation systems to replace the old method of suing and hoping to maybe get paid after being hurt at work. - The general abolition of the idea, at least in most of the safety field, that the individual is to blame for the bad things that happen to them at work. * - There are, of course, exceptions to the above and examples of where activities related to OHS have been undertaken in earlier times. This list is meant to present progress that current societies have generally made in this area. --- There's nothing wrong with taking the time to enjoy progress that has been made while still striving for improvements. In addition, we can look to the past to see how these changes were made to better understand the pathway to future safety improvements. --- #safety #occupationalhealthandsafety #professionaldevelopment

It is therefore essential to ensure that employees are kept informed about how to keep themselves and their colleagues safe in the working environment. The Occupational Health and Safety Act (Act 85 of 1993) (OHS Act) serves as a guide to remain proactive in maintaining a healthy and safe working environment for everyone. The OHS Act states that is the responsibility of the employer, where reasonably practicable, to ensure a safe working environment for employees that is free form danger or risk and remain compliant with legislation. However, Section 14 of the Occupational Health and Safety Act (85 of 1993) states that employees need to look out for their own safety as well as the health and safety of those around them. Health and Safety is everyone’s duty and responsibility. How can employers and employees work to move closer to health and safety compliance? 𝗢𝗛𝗦 𝗧𝗥𝗔𝗜𝗡𝗜𝗡𝗚 In the event of an emergency, employees and management alike should have the basic knowledge on how to manage the situation through the following: • First aid training • Fire and safety training • Risk related training • Health and safety representatives • Accident investigators 𝗢𝗛𝗦 𝗜𝗡𝗦𝗣𝗘𝗖𝗧𝗜𝗢𝗡𝗦 Workplace inspections are an essential component of your prevention program.
