On 10/7, I felt the air leave the room, and it got worse with each passing day as more details of the 10/7 massacre became available and as I saw the veil lifted on virulent antisemitism all over the world. Slowly I became accustomed to the lower level of oxygen. Now, again, I feel as if I can barely breathe. If Iran is the #1 state sponsor of terrorism, what does that make us if we transfer more money to the regime? The regime hates America. I joined the 20th Convening of the Counter-ISIS Finance Group to discuss ways the US government and our allies not only hold ISIS members accountable for their atrocity and terrorism crimes but also pursue ISIS’s financial enablers—those who provided or facilitated financial support. The transforming system of crypto-currencies provides further means of conveying funds to terrorist groups and enhancing the anonymity of donors; we and our allies must work creatively to develop robust counter-financing systems, investigatory mechanisms, and prosecutorial frameworks to hold terrorist financiers to account. The Anti-Defamation League has just filed a groundbreaking federal lawsuit against Iran, Syria, and North Korea for providing material support to Hamas for the violence committed in Israel on October 7, 2023. This case, with over 125 plaintiffs, marks a historic moment as the first brought by a Jewish organization to hold state sponsors of terrorism accountable. A confessed terrorist freed in Washington DC In April of 2020, Alexander Alazo Baró fired 32 rounds from an AK-47 into the Cuban embassy in DC. Alazo was apprehended immediately and confessed to the attack. Yesterday, he was found not guilty in an American court. Make no mistake, this was a terrorist act perpetrated in the capital city of the United States against Cuba. The Cuban people are outraged that Alazo Baro is now a free man despite his stated intention to kill Cuban nationals in the embassy. Three years later, in September of 2023, the Cuban embassy in Washington was again attacked, this time with Molotov cocktails striking the embassy walls. The US law enforcement authorities still claim not to know who the perpetrator was or what the details of such action were. To be clear, not once in its history has the Cuba government ever engaged in any hostile act towards the American people or their government yet these two attacks, originating on American soil, add to the list of over 3000 hostile acts perpetrated on the Cuban people from those within the United States. Why? Cubans are a gentle people who wish nothing more than to live in peace with their neighbors to the North. And this is how we are treated? Why? Why does the American government allow these attacks to happen? We beseech the American people to stop hurting us. Cuba means you no harm. We never have and we never will. "More than 100 victims and relatives of victims of the Oct. 7 attack by Hamas in #Israel sued #Iran, #Syria and North #Korea [in federal court in Washington, D.C.], accusing the countries of providing Hamas support and demanding at least $4 billion in damages... It is common for countries accused of state-sponsored terrorism to ignore lawsuits in the U.S. and not to honor judgments against them in U.S. courts. If the defendants are found liable, the plaintiffs hope to tap the U.S. Victims of State Sponsored Terrorism Fund, which Congress created in 2015 to compensate individuals who have won judgments against state sponsors of terrorism. This news out of Germany is concerning. Just a few quick observations on this latest effort by IS-K to inspire, coordinate, and conduct a terrorist attack outside of Afghanistan. https://lnkd.in/eByDAQGG 1) The terrorism threat is persistent – even if we want to focus on other important security priorities, the terrorists haven’t moved on. Continued attention and resources are necessary to ensure that terrorism does not disrupt other important priorities. 2) IS-K attempts to strike again – Among the two most prominent violent Sunni jihadi organizations (AQ and IS), this plot is another demonstration of the fact that IS-K is the most active and dangerous coordinator of operations outside its own zone of active conflict. See: https://lnkd.in/eD3HH5Zg 3) The motivating factors are many – this attack appears to have been motivated by events related to the burning of the Quran in European countries, not more recent events in the Middle East. This is not good news, but a reminder that there are an increasing number of issues that might motivate individuals to carry out attacks. 4) The time lag is worth noting – it is possible that at least several months and possibly more than a year passed between the motivating events (Qur'an burnings beginning in January 2023) and the disruption of the plot. This gap makes it hard to anticipate when the motivating fuel from a particular incident has run its course. It also means that keeping our guard up is essential. 5) Low tech plot foiled by lack of access to weapons – Nothing seems very sophisticated about this plot: attacking people with a gun. However, it seems that the lack of ease of access in the location where the plotters lived was a factor. According to prosecutors, the individual plotters tried “several times, although without success, to acquire weapons.” 6) The Camps in NE Syria – according to one report, these individuals had raised over €2000 for people imprisoned in camps in Syria. These camps, and fundraising efforts related to them, remain an important connecting issue for sympathetic Islamic State members around the world. See: https://lnkd.in/e38eimSg 7) Immigration status – No need to fear monger on this issue. Early reports state that these individuals are Afghan Nationals. Understanding when and how they came to Europe will be an important part of the investigation moving forward and could be useful in revisiting the processes used to determine potential threats.

FATF President T Raja Kumar. Raja Kumar, at the UN Counter Terrorism Committee in NYC, outlined how the FATF would take forward the fight against terrorist financing (TF) over the next two years. Among the issues he highlighted were a comprehensive update on TF financing methods and trends; the new round of mutual evaluations; increasing support for the Global Network; and being "laser-focused on ensuring that the implementation of FATF Standards does not have negative effects on NPOs and civil society," he said. What is a Specially Designated Global Terrorist (SDGT)? Did you know that SDGTs include banks and charitable organizations that materially support terrorist groups? That is right, an SDGT can be a seemingly innocuous entity that itself does not actually go out and blow people up or engage in what we think of as terrorist activities, but because they provide financial or other support to a terrorist group, they are designated as SDGTs. US persons are prohibited from any kind of transactions with an SDGT. “US persons” includes foreign nationals in any status in the US, including a B visitor or ESTA. Additionally, foreign nationals outside the US, even if they are not US persons, can be banned from entering the US if they have any dealings with an SDGT under the material support grounds of inadmissibility. This may be slightly counter-intuitive, as DHS and the State Department may interpret the ground of inadmissibility to include material support to a material supporter, as you may be two steps removed from the organization that is actually conducting the terrorist activities, and still be barred from entering the US or adjusting. I had the exceptional honor of testifying before the United States Senate Committee on Banking, Housing, and Urban Affairs during its hearing on "Combating the Networks of Illicit Finance and Terrorism,” in light of the recent horrifying terror attacks by Hamas, taken from the ISIS playbook. I opened my statement by sharing the personal stories of two children from our school in Israel who were slaughtered in their home during the barbaric attacks. I also mentioned a young woman who was shot at a rock festival and is now being held hostage by Hamas. Terror organizations cannot operate without funding. To effectively combat terrorism, we must cut off their oxygen, their financial resources, similar to what was achieved with Al Qaeda after September 11th and with ISIS. I call for the establishment of a global coalition for financial sanctions, mirroring the actions taken against ISIS and Al Qaeda. Hamas should be designated as a terrorist organization by the UN, in addition to its existing designations by the US, EU, and other countries. This designation should extend to cover all global financial institutions and currencies. Existing designations should be expanded and enforced, with secondary sanctions imposed on non-compliant stakeholders. There should be a heightened focus on combatting and tracing trade-based, hawala, and money transmitters linked to terrorism. The global regulatory framework for Virtual Assets should be enforced, including urging the Financial Action Task Force (FATF) to publish a "grey list" of jurisdictions that haven't fully adopted and implemented the global framework or conducted appropriate supervision. Furthermore, non-compliant Virtual Asset Service Providers (VASPs), which are often situated in non-compliant countries, should face individual sanctions. The fight against terrorist financing is complex and challenging, but it's a battle we must win. We must protect our citizens from the threat of terrorism by cutting off the flow of money to terrorist organizations. Let's find a way to ensure that terror does not happen again, not in Israel, and not in any other country. Analysis of the Israel-Hamas hostage deal - and its consequences: 1. Any unequal deal sets a precedent for the future. In this case, Israel agreed to release three convicted or lawfully arrested individuals for each innocent hostage - among other concessions. The deal is unequal by number and by status. It shows a major imbalance of power awarded to terrorism. 2. Any deal that rewards bad behavior encourages more of the bad behavior. In this case, terrorism awarded Hamas the release of prisoners and other concessions from Israel. The likely result then is more terrorism, more hostage deals, and a downward spiral for legitimate negotiation. 3. Any party that gains power through terrorism encourages its peers to acts of terrorism. Hamas has a competitive advantage over Fatah and other organizations who don’t engage in their level of violence to deliver greater results. This means that Hamas will likely either replace Fatah in the West Bank or Fatah will become much more violent in order to deliver similar results. 4. The suspension of Israel’s mission to destroy Hamas - even if brief - means that Hamas has the opportunity to rest, re-supply, plan, and reposition. The likely result is more lives lost. So while Israel sees the return of a small number of hostages, it’s at the likely cost of many more lives. 5. Negotiating with terrorists legitimizes, empowers, and encourages them. It’s hard to say “no,” but rewarding their activities is exactly what creates their activities. Israel fell into a trap that will be even harder to escape in the future. 6. The United States (and other parties) likely created new dangers for their citizens and interests by pressuring Israel into a catastrophic deal that further loosens the rules on terrorism - something that will be felt across the globe. 7. Public perception is often shaped by mixed signals. The moment the negotiations came into the public eye - when it was visible that Israel was talking to Hamas - Israel’s message that Hamas is an evil terrorist organization was undercut by its willingness to negotiate and even to concede to them (no matter how distant or slight). This moved the needle in Hamas’ favor. In summary, terrorism won every major aspect of this deal. The losers are innocent civilians and legitimate governments.
