Getting your patent declared a “Standard Essential Patent” (SEP) is great for business as it ensures recurrent revenue. The only “but” is that the price negotiations with licensees tend to be long and expensive. Tesla-Avanci negotiations are a case in point.
Smart cars and SEPs Cars are increasingly becoming intelligent products and require a high level of connectivity. This is today made possible by 4G and increasingly by 5G technology. Car manufacturers such as Tesla therefore need to acquire licences for those digital technologies. The current challenges to negotiate a licence between car manufacturer Tesla and digital companies InterDigital and Avanci is illustrative of the challenges of introducing new digital technologies into this market. #Smartcar #Tesla #5G #SEP

Tesla's UK lawsuit against InterDigital and Avanci has been thrown out by a UK court. Tesla was seeking a patent licence for 5G technology ahead of its launch of 5G vehicles in Britain. The US automaker wanted the court to determine fair and reasonable terms for a licence to use patents owned by InterDigital and licensed by Avanci. However, InterDigital and Avanci asked the court to throw out Tesla's bid, which was granted on Monday. The High Court ruled that Tesla's bid for a licence must be thrown out, but its claim to revoke three of InterDigital's patents can continue. The ruling is a setback for Tesla's plans to launch 5G vehicles in the UK. Chief Executive Carlos Tavares in February made an intriguing announcement: The Chrysler-parent company would remain all-in on electric vehicles, even as competitors scale back and sales growth slows. “We’re going flat out,” he told analysts on the company’s earnings call. The 65-year-old’s view on battery-powered vehicles is a drastic change from just a year ago, when he sounded the alarm on the high cost of EVs. Now, Tavares is more bullish, driven by the company’s flexible vehicle platforms and the fact that Stellantis’s EVs are already profitable. Tavares says the company is staying the course with an ambitious goal it staked out two years ago: to make 50% of Stellantis’s U.S. sales volume all-electric by 2030, buoyed by its popular Jeep SUV and Ram pickup brands. A part-time race car driver, Tavares has always stood out among his peers as an executive who moves to the beat of his own drum. While Stellantis has sold electric models in Europe the past few years, the U.S. was put on the back burner for some time.
