If you're an insurance defense or insurance coverage attorney, you'll want to read this. The data reinforce what my LHH colleagues and I already felt in our bones: Insurance law is HOT in Chicago. In Q1 2024, there have been more lateral insurance hires in Chicago than any other city in the country, nearly doubling the next closest contender (NYC). In fact, Chicago has seen a whopping 75% Q/Q increase in the number of lateral insurance hires, and we still have roughly two weeks to go in Q1. Surprisingly, national numbers paint a very different picture, reflecting a 23% Q/Q *DECREASE* in the number of lateral insurance hires. You could say that nationwide is NOT on your side. (Figured you earned a dad joke for reading this far.) Bottom line, if you are an insurance coverage or defense attorney in Chicago, you are in extremely high demand at a time when insurance law has cooled significantly in other markets. When dealing with a recovery case, how do you go about appointing the right claims handler for the job? 🫵 Recovery opportunities are often missed because of different reasons: 1️⃣ Recoveries are left to the very end of the claims process… and overlooked altogether. 2️⃣ Information pointing to a likely recovery may be hidden in the claims narrative. 3️⃣ Insurance claims staff’s focus is on keeping insureds happy by settling cases sooner rather than later. On top of all this, marine recoveries can be utterly complex. So, it takes a highly specialised claim handler to maximise your chances of recovery. The issue is 𝗰𝗹𝗮𝗶𝗺𝘀 𝗵𝗮𝗻𝗱𝗹𝗲𝗿𝘀 𝘄𝗶𝘁𝗵 𝘁𝗵𝗲 𝗯𝗿𝗲𝗮𝗱𝘁𝗵 𝗮𝗻𝗱 𝗱𝗲𝗽𝘁𝗵 𝗼𝗳 𝘀𝗸𝗶𝗹𝗹𝘀 𝗻𝗲𝗲𝗱𝗲𝗱 𝗮𝗿𝗲 𝗵𝗮𝗿𝗱 𝘁𝗼 𝗰𝗼𝗺𝗲 𝗯𝘆… And even harder to retain! Insurance industry studies point to a talent crunch caused by: 👉 An increase in business volume. 👉 Experienced agents retiring. 👉 A shallow talent pool. 👉 A shift of demographics, with Millennials and Gen Zers reshaping the workplace. In this scenario, building a team of qualified claims handlers to look after your insured when there’s a loss is no easy task. For a start, your staff needs to meet certain non-negotiables: claims experience, communication skills, business acumen and analytical skills, to name but a few. Now, imagine you’re dealing with a high-value collision between vessels flying under separate state flags in international waters. And, to make matters worse, it involves loss of life. Depending on the merits of the case, there may be potential for recovery. But, in order to uncover it, you’ll need a claims handler who: 👉 Has a deep knowledge of different jurisdictions and legal systems. 👉 Has a good understanding of policy provisions on subrogation and recovery actions. 👉 Speaks other languages and is acquainted with the local culture. 👉 Has the technical skills needed to assess damage and value of repairs. 👉 Knows how to decipher evidence to identify liable parties. 👉 Has the ability to turn conflicts into beneficial outcomes. 👉 Can balance the costs of pursuing recourse against the potential recovery. If your claims handlers don’t fit the bill, they won’t be able to 𝗱𝗲𝘃𝗲𝗹𝗼𝗽 𝗮𝗻 𝗲𝗳𝗳𝗲𝗰𝘁𝗶𝘃𝗲 𝗻𝗲𝗴𝗼𝘁𝗶𝗮𝘁𝗶𝗼𝗻 𝘀𝘁𝗿𝗮𝘁𝗲𝗴𝘆 𝘁𝗼 𝗽𝘂𝗿𝘀𝘂𝗲 𝗿𝗲𝗰𝗼𝘃𝗲𝗿𝘆.
