Shared with permission from the PT, 2 October 2024: ⚖️Pestalozzi Trust⚖️ 🚨TOP PRIORITY - BELA UPDATE ‼️Pestalozzi Legal team reviewing the status of BELA Act. *Short Version* The BELA Act may not be in force yet. That would mean the 30 days registration period has not commenced yet. The legal team is finalizing their research and will share their findings. We urge everyone to await clarity before taking action. *Long Version* The Pestalozzi Trust met with our legal team to review all the recent information relating to the manner in which the President signed and published the Bill in the Gazette and further developments since last week Monday. There is public legal debate on the manner in which the President has acted and the current position is unclear. The legal team is investigating the arguments for and against the inception date of the Bill being the 16 September. Initially, on the face of it, and based on the President’s clear statement that “I've therefore decided that having signed the bill the bill must now proceed to be implemented and I'm glad that the minister of basic education has clearly said that once signed this becomes the law of the Republic and the department meaning herself the deputy Minister and the department will go ahead and implement of implementation of course the commencement to implement is a date [this passage is unclear but could indicate an intention to set a commencement date] that needs to be set so implementation on signing should start immediately” the default commencement date appeared to be the 16 September. These statements are clear: “having signed the bill the bill must now proceed to be implemented” “that once signed this becomes the law of the Republic and the department meaning herself the deputy Minister and the department will go ahead and implement” “so implementation on signing should start immediately.” Later, “the rest of the Act is implemented immediately”. However, when gazetted on Monday 16 September the commencement date was not indicated and this has since led to a public legal debate on whether this gazetting is adequate. A number of organisations and the public in general are acting as if the Act, other than Clause 4 and 5, is in force. This is, however, not clear and for this reason we have asked our legal team to finalise their research as it is vital that the public have certainty on the date of commencement. Once this legal research is completed the legal team will be preparing a note that we will be sharing with members. A further letter to the President could be sent to the President to obtain clarity and stating the Pestalozzi Trust’s legal position on behalf of its members. We will return to corresponding with the Presidency on our first letter after this is decided.

Why do we put up with a Crown Law Division that seems always to be siding with villains and rouges disguised as Govts .No matter how unjust unfair illegal a Govts action was or is Crown Law always takes the view that because they represent the Govt of the day that Govt can do No Wrong .This is especially true in criminal convictions found to be unjust and unfair. They still seek to oppose any reviews or compensations etc SeeBelow. For disgraceful disrespectful CL behaviour. Eg In the 10ths Case below NZ Law needs to change to seek a more mediated resolution of disputes rather than the We win You lose court room law of the jungle.To remain law that citizens will accept ;it must be seen to be fair and just not just be technically the current law🙁😇
During our hearing, the Crown argued that kaumātua Rore Stafford lacked representative capacity to receive any relief on behalf of Ngā Uri - the beneficiaries of the Nelson Tenths claim. The Crown argued that Uncle Rore did not have the support of the customary owners. It was difficult for the Crown to understand that Uncle Rore seeks relief not for himself, but for our collective group, and has done for more than 30 years. In his evidence, Te Here-ā-Nuku Working Committee member Ropata Taylor responded: “This is how our people viewed the whenua in the past and that is how we continue to treat our whenua and resources now - collectively. Uncle Rore is leading this kaupapa for us all. He is the leader charged with nurturing the mauri of this claim, for us all, with the endorsement and tautoko (support) of the customary owners.” #makingthetenthswhole #tehereānuku
