My own professional thoughts on this. An opinion not a legal ruling. 😊 Rule 14(a) uses the word course rather than heading which in my opinion is not ideal and, I suppose could be seen to lead to possible ambiguity. Having said that rule 14(b), I believe, clears up any ambiguity by defining when a head on situation should be deemed to exist. 14(b) It applies to your individual vessel and takes no account of the perspective of the other vessel. Furthermore, If there is doubt in the mind of the navigator they “shall” (not “may”) assume that a head on situation exists and act accordingly. 14(c) must be invoked. Never forget also that even if you consider yourself the stand on vessel you can, invoke rule 17 (a)(ii) and “may” take action to avoid collision by your manoeuvre alone, as soon as it becomes apparent to you that the vessel required to keep out of the way is not taking appropriate action in compliance with the colregs. “When it becomes apparent” is very subjective and not defined. Under rule 17(b) you are only obliged to take action as the stand on vessel when, from any cause, you find yourself so close that collision cannot be avoided by the action of the give-way vessel alone, then you “shall” take such action as will best aid to avoid collision. A prudent navigator however, in my opinion, would use 17(a)(ii) before reaching this point. Most practical Colreg scenarios out at sea are clear and taking the correct actions is straightforward. However multi vessel scenarios can create complex situations that need careful thought. As always when an incident ends up in a court of law then words really do matter, the lawyers love those types of legal arguments, my advice is to avoid the incident at all costs. 👍😊 #maritimesafety

One of the reasons I decided to come back to Hall & Evans recently is that the attorneys here know how to try cases and aren't afraid of the courtroom. I've tried more than fifty cases to juries and it's important to me to work with other attorneys who not only understand courtroom litigation, but actually have the experience doing it. One of the skills you can only develop through actual trial work is picking and advocating to a jury. For the litigators out there, please consider coming to the CBA Litigators' Summit this Thursday where I'll be presenting about the impact of diversity on jury deliberations and how to create diverse juries. Research shows diverse juries have wider ranging deliberations and reach verdicts that are better across almost all metrics. Plus diversity protects against deliberations tainted by bias and ignorance. And because those still impact trials shockingly often, I'll be discussing steps trial lawyers can take to ask for a new trial when verdicts are based on animus and harmful stereotypes, rather than actual evidence. As attorneys on the front lines of often high profile trials, it serves the interests of our clients and our communities to pick juries who will reach fair and unbiased verdicts and increase confidence in the court system.
