Groundbreaking research is happening at Augusta University with a new method to treat fentanyl addiction using a cannabidiol, or CBD, based therapy. In my practice, dissecting opposing expert reports is a routine, But occasionally, one reads like a poorly scripted drama. Here's what I've gleaned: A standard expert report in neurology should: 1. Validate the expert's credentials. 2. Methodically lay out the case timeline. 3. Delve into the critical neurological issues. 4. Present a well-reasoned, evidence-based opinion. 5. Allow for revisions based on new information. But not all reports live up to this standard. Some time ago, I authored an exemplary report, Adhering to these key steps, Praised by the retaining attorney as ‘excellent’ for its thoroughness and clarity, With minimal revisions, it was finalized and submitted. However, reviewing a recent defense expert's report was an eye-opener: The misalignment in timeline and facts was startling, It seemed like a different case was being described. The climax of this report was particularly egregious: A broad, unsubstantiated concussion prognosis, Without addressing the critical 'guidelines.' Following a strategic discussion, My attorney client was armed with: A robust 11-page IME report rooted in neurological expertise. The upcoming attorney meeting is poised to be revealing. Remember, in IME report writing: It's about the irrefutable facts of the past medical event and guidelines, Not about overpowering assertions. Attorneys seek truth, not theatrical bravado.
