We've enhanced our case law portfolio through an ongoing partnership with 上海仲裁委员会 Shanghai Arbitration Commission (SHAC), providing access to anonymised and redacted arbitral awards 🤝 📑 In a recent case summarised and curated by the SHAC's experts, the claimant sought emergency arbitration against the respondent for failing to fulfil repurchase obligations per their agreement. The claimant requested interim measures to freeze the Respondent's shares to prevent asset dissipation. The emergency arbitrator granted the measures, considering the likelihood of the Claimant's success, the urgency, and the potential irreparable harm. The interim measures were recognized and enforced by the Hong Kong High Court, showcasing the effectiveness of emergency arbitration in preserving parties' rights.
