Today’s takeaway comments about property development vs. wetlands and biology at today’s #NorthStateBIA event: Comment: There’s nothing easy about wetlands permitting. Response: You’re right. The requirements and timelines often do not make sense or are overbearing. The best way to manage these issues is knowing what you are dealing with before buying or applying and then planning your desired outcome. Comment: Is it faster to go through state or federal permits? Response: The EPA’s recent decision to exclude isolated wetlands and waters from federal jurisdiction creates confusion, but also opportunity. State permitting guidelines require agencies to permit projects in 3 months if a complete application is submitted. Comment: The biggest issue we have is with poor customer service and project management. Response: Absolutely. No developer or builder wants to manage someone else’s job. Effective tomorrow, new bald and golden eagle take regulations go into effect. The new regulations will have particular import for qualifying wind energy projects and should serve to streamline the existing incidental take permitting process, provide greater regulatory certainty to project proponents, and encourage increased participation in the eagle take permitting program. Big news for eagle conservation! 🦅 Starting April 12, 2024, the U.S. Fish and Wildlife Service's new regulations for eagle take permitting are in effect. These rules maintain specific-permit activities while introducing a general permit system for lower-risk activities. Agency coordination is a huge part of what we do. It’s also the part of the process that for some, causes the most stress. However, the better you understand the processes involved, the easier it will be for you and the agency you’re working with to ensure your site stays compliant. This involves having at least a base-level understanding of regulatory requirements - such as the Endangered Species Act. It also frequently requires a discussion to establish specific concerns or best management practices for protected species in the area. This preliminary understanding ensures we gather the necessary data when surveying your site. Once the agencies have the data, it’s much easier for them to help us determine the necessary permits. Our foundational work significantly streamlines the permitting process. It makes their life easier, our lives easier, and your life easier. Throughout the project, we’ll be there to provide the agencies with regular communication, and should there be an unexpected development that requires project modifications, we’ll be able to communicate with the necessary departments in a timely manner. Nearly two years ago, in September of 2022, the EPA announced that they were adding the Lower Hackensack River in Bergen and Hudson counties to the Superfund National Priorities List (NPL). Since that time, many current and past owners and operators of properties located around the watershed may have received a Notice Letter asking for information regarding hazardous substances. The law enforcement challenges in Game Management Areas (GMAs) The general structure and management strategies of most Protected Areas is that National Parks are surrounded by areas with a significant diversity of natural resources (wildlife, water bodies/fishes or forests) but do not qualify as national parks due to others factors such as human populations, infrastructure development to provide social services to the public etc. So these places in other jurisdictions are called by several names: in Zambia, they are referred to as GMAs. Then there are other less protected areas beyond these GMAs called Open Areas. Each country will have specific names and classifications for its own protected areas. The issue of names is not important for now, but challenges that such places have in the context of law enforcement. I have put these challenges in groups as shown below. Resource Protection: 1. Poaching 2. Habitat encroachment and human-wildlife conflict 3. Uncontrolled fires and habitat degradation 4. Inadequate resources (e.g. vehicles, equipment, and personnel) Strategic Challenges: 1. Limited community engagement and support 2. Insufficient collaboration with neighboring protected areas 3. Inadequate intelligence gathering and sharing 4. Limited capacity for proactive law enforcement Technical Challenges: 1. Limited training and expertise in law enforcement and conservation 2. Inadequate equipment and technology (e.g., patrol vehicles, communication devices) 3. Limited access to forensic analysis and investigative support 4. Inadequate data management and analysis capabilities Administrative Challenges: 1. Limited personnel and inadequate staffing levels 2. Inadequate logistical support (e.g., fuel, maintenance, supplies) 3. Limited budget and funding constraints 4. Inadequate policy and legislative framework support To address these challenges, the law enforcement agency can: 1. Enhance community engagement and outreach programs 2. Strengthen collaboration with neighboring GMAs and national parks 3. Develop and implement effective intelligence gathering and sharing systems 4. Provide regular training and capacity building for law enforcement personnel 5. Invest in equipment and technology upgrades 6. Develop and implement effective data management and analysis systems 7. Strengthen logistical support and budget management 8.
