It can be very uncomfortable to dismiss a federal class action in favor of state court. But it can be done. Check out this blog post by Ross Weiner where he discusses Dougan v. It took me a while to wrap my head around this ruling because it completely contradicts the law. In my estimation, Judge Cannon is opening the door for a US Appeals Court to strike down the regulation that allows for the Special Prosecutor Appointment.
