It can be very uncomfortable to dismiss a federal class action in favor of state court. But it can be done. Check out this blog post by Ross Weiner where he discusses Dougan v. Centerplate, the unique case history, supporting federal rules and judicial reasonings. Such a dismissal, so long as it is agreed to by all parties, should be automatic and need not trigger or require any substantive review by the court. It took me a while to wrap my head around this ruling because it completely contradicts the law. In my estimation, Judge Cannon is opening the door for a US Appeals Court to strike down the regulation that allows for the Special Prosecutor Appointment. This follows the SCOTUS decision to strike down Chevron Deference. #LegalAnalysis #JudicialRuling #AppealsCourt #SCOTUS #SpecialProsecutor #ChevronDeference #RuleOfLaw #JusticeSystem
