R(Finch) v Surrey [2024] UKSC 20: It is very interesting to see the huge impact of An Taisce's Glanbia and Edenderry cases in this UK SCt Judgment on Climate Change. This shows that litigation of complex issues serves an important public good, even when (in the Glanbia case for example) the outcome is on paper a "loss". The Glanbia case in particular was relied heavily on by the Court and is referenced in their conclusion, as an important articulation of the nature of indirect impacts that should be taken into account in Environmental Impact Assessment of a project. In this case the UKSCt found that the impacts of the oil burned on climate change should have been taken into account when assessing a proposed oil drilling project. Consideration is also given to the meaning of transboundary impacts in an EIA context. The power of EIA as a tool in the mitigation of climate change is also clear here. #Finch
Major environmental law case: Supreme Court decision in Finch. Planning practitioners need to be aware of this case (and will hear plenty about it I expect!) and it marks a significant development in climate change litigation. The Supreme Court has handed down its judgment in Finch. By a majority it has said that the greenhouse gas emissions which result from burning fossil fuel, in this case oil, post a refinement process, should have been taken into account in Environmental Assessment work which related to an application for consent for the extraction of that oil. This sort of effect is indirect, but of obvious importance to the environment. The judgment sets a benchmark for what environmental assessment work should include. I certainly welcome an outcome which helps us better understand the effect of decision making on greenhouse gas emissions and the climate… There are other subtler points about the scope of the court’s review in this context, which will be of interest to the real enthusiasts!

1moWhat are you going to do about the shards of fibreglass that continually come off the blades and enter the water? There has been a fair bit if research done to support these as not being environmentally friendly options. With beaches in America being closed due to public safety by these shards washing up. I do not think that there is enough actual research gone into the fully effects that these windmills have on the environment. Both on land and water. It is only now all coming into the spotlight what environmental damage they are causing. It is all just a money grab by the plant owners and manufacturers. These are not recyclable. So how can that be environmentally friendly?
