In-house counsel are like the fireproofing in a building. You don't see it, you may not even know it's there, but it's silently working around the clock to protect you. And it's not until a fire threatens to break out that you appreciate its value. Similarly, in-house counsel are consistently identifying, analyzing, and addressing risks that could wreak havoc on your business. They're the ones: 1️⃣ scrutinizing contracts, spotting potential pitfalls and ambiguities that could later turn into expensive litigation. 2️⃣ staying up-to-date with ever-changing regulations to ensure your organization doesn't unintentionally step out of line. 3️⃣ ensuring compliance across departments - HR, product, marketing, and more. But because much of their work is preventive, it often goes unnoticed. After all, it's hard to appreciate the disaster that didn't happen, the crisis that was averted, the lawsuit that never materialized. “We should’ve taken your advice at the time” is the last thing I want to hear from a client. I sincerely don’t want any “told you so” moments because that means there were some consequences for my client. The fact of the matter is many business owners can get away with things for a long time and assume slience = compliance. This extended silence can cause business owners to feel too comfortable. I am constantly reminding my clients that all takes is one employee to blow the whistle or one attorney who wants to look deeper “under the hood” of the business. If the business is out of compliance, there will be consequences. Point being—- let’s get things right today so you don’t have to worry about tomorrow. I got to thinking over the Labor Day weekend. Besides the cost, what's bothers clients about litigation the most. Delay. Most clients agree that litigation takes too long. In this week's vlog I share some thoughts about why litigation takes so long and how the litigation process can be used as leverage by the party seeking delay. I also discuss the big risk associated with delay, namely the award of interest on top of a monetary judgment.

IT'S NOT ABOUT THE MONEY Of course we all want to be successful but my recruiters tell more attorneys to stay put, than anyone in the profession. Why? Because that's often what is best for them. And we won't make a deal, if the only benefit is our commission. We will only coordinate a move if it truly benefits everyone involved. The attorney (or group or smaller firm) come first. People before profits. Of course, the client has to benefit too - which they do. Only after we're sure everyone else is truly going to benefit, do we benefit. Our corporate motto is "All ships rise with the tide. We will not endeavor to have the biggest ship. We will be the tide." That's too long to fit on a coffee cup, so we had to condense it a bit. 😁 #legalrecruiters #corporateconscience

Litigation is expensive. This is why: Take any business. John Doe files a lawsuit against it. Maybe it’s a breach of contract. Or a violation of a statute (e.g., FCRA, TCPA, etc.). Substantively, it won’t matter (at least for the first couple of months). Because once the company is served, it has to hire counsel. And the reality is harsh - pay the plaintiff now for finality or defend. Indefinitely. Sure, counsel can try to have the case dismissed. But if the plaintiff survives the motion, the company is living it for the next year. At a minimum. Maybe the company wants to avoid these types of claims in the future so it defends. But is the appearance of a strong defense a smart way to deploy capital? Will this defense provide an ROI on the company’s time, cash, and consumption of internal resources? Is the plaintiff’s demand so unreasonable that the company has to defend? Many questions. Few answers. And costs for the foreseeable future. **NOT LEGAL ADVICE.
