On the same day as a great conference on the opportunities of the Digital Markets Act, the European Commission has opened yet another DMA non-compliance investigation. The investigation focuses on Apple’s new contractual requirements for app developers breach the DMA. These requirements include a “core technology fee,” which charges developers of third-party apps €0.50 ($0.54) each time their app is installed. In addition, the European Commission has informed Apple of its preliminary view that its App Store rules are in breach of the Digital Markets Act, as they prevent app developers from freely steering consumers to alternative channels for offers and content. Apple can face fines up to 10% of the company’s worldwide revenue. A final decision is due by March 2025.

The availability of alternative app store features is contingent upon the user's Apple ID region and the geolocation of their device, ensuring compliance with regional regulations. For users with an EU Apple ID and physically situated within the European Union, the functionality of alternative app stores is now accessible. However, leaving the EU entails potential limitations, including the inability to install new alternative app marketplaces and update existing apps downloaded from such stores. This shift marks a significant step in diversifying the app ecosystem while adhering to regulatory frameworks. To address the challenges posed by travel outside the EU, Apple has outlined a grace period of 30 days. During this period, users departing the EU can still receive app updates from alternative stores, offering a temporary solution for continued access. However, it's essential to note that this grace period solely applies to app updates already installed on the device and does not extend to installing new apps or acquiring new app marketplaces. Despite the grace period, maintaining physical presence within the European Union remains crucial for certain app functionalities. In good news for App developers, the EC has indicated that Apple's App Store Terms need to change to comply with EU law (DMA) which could result in lower fees and greater freedom and choice for users (including lower prices). Here are the main issues (and resultant benefits for developers): Apple currently enforces three sets of business terms for app developers, which the European Commission finds problematic: 1️⃣ Communication Restrictions: 👉Developers cannot provide pricing information or promote alternative offers within the app and there are strict limits on how developers can communicate with their customers about offers available outside the App Store. 2️⃣ Link-Out Limitations: 👉Developers are allowed to include links in their apps that redirect customers to a web page for making purchases. However, this link-out process is heavily restricted and and cannot conclude transactions within their apps, forcing users to navigate away from the app. 3️⃣ Excessive Fees: 👉 The fees for facilitating the initial customer acquisition and additional fees on developers for every purchase of digital goods or services made within seven days after a user clicks a link-out from the app are excessive. The Commission wants Apple to revise its business terms to comply with the DMA thereby offering developers greater freedom to inform their users about cheaper and alternative purchasing options which I'm sure will be welcomed by the App developer community. #DMA #Apps
