New York Supreme Court Ruling on Greenidge Generation Highlights Key Legal Boundaries in Environmental Regulation On Nov. 14, 2024, the New York Supreme Court issued a significant ruling in Greenidge Generation v. NYS DEC, affirming the DEC's authority to deny permits based on greenhouse gas emissions under the Climate Leadership and Community Protection Act (CLCPA). However, the court found procedural errors in the DEC’s denial of Greenidge Generation’s Title V Air Permit, citing a lack of required justification analysis under CLCPA Section 7(2). The ruling highlights that while regulatory agencies can enforce strict emissions standards, they must also adhere to procedural requirements. 📰 Catch me up: On June 28, the U.S. Supreme Court overturned the Chevron deference, a 1984 ruling declaring that, in instances of ambiguously worded legislation, the Environmental Protection Agency and other federal rulemaking bodies’ interpretation and enforcement of specific statutes would merit judicial deference. 😮 What were the reactions? Trade associations representing a cross section of American companies celebrated an unalloyed victory for business interests. Law firms representing individual business sectors applauded their clients and recommended an expansive application of the decision’s reach beyond current policy and regulatory processes. Nongovernmental organizations regarded the court’s decision as a significant setback for the assertion of executive authority to remedy pollution, worker protection, financial transparency and a host of other priorities. ❓ What’s happening now? Non-regulatory governance and policymaking options are expanding and will receive added impetus from the repeal of Chevron deference.
