It was a pleasure to chat with Anthony Badaracco on the nuances of US antitrust law, including the most crucial and pragmatic question: what conduct is prohibited and what is permitted. In my view, antitrust is one of area of the law that is remarkably counterintuitive. Agreements that are anti-competitive can seem innocuous while other business practices that may seem suspect are permitted or at least defensible under a "rule of reason" or doctrine. So it's important to have a refresher on US antitrust law from time to time. I trust this will be useful to many both, here in the US and around the world. #litigationrisks

In antitrust cases, the "quick-look" methodology is—in theory—available to summarily condemn conduct that has obvious anticompetitive effects, even if the conduct does not fall within the narrow confines of the "per se" rules. My Jones Day colleague Jonathan Berman is the author of an article, accepted for publication in the American University Business Law Review, that examines how, in practice, the quick-look methodology has proven unworkable and attempts to invoke the methodology are unlikely to accomplish anything other than making the underlying lawsuit more complicated and protracted.
