I've been following Shomotion a Bit for their Cool 😎 content. For those wondering 🤔...about DOT applicability for this movement, IN the US... For Educational reference...The Reality of DOT Regulations is... An Ford F-250 Pulling a Landscape Trailer, not requiring a CDL,... HAS MORE "potential" to be applicable to DOT regulations than this set-up 😳. *Techically, the Advertising may establish "Commerce", BUT a DOT Inspector is REQUIRED to "Prove Commerce" PRIOR TO an Inspection. If, big IF, there is ZERO Commerce with this type of Movement... ZERO DOT regulations apply! "Commerce" is covered under 49 CFR 390.3 that can found at and reads (*Emphasis on the word Commerce)- https://lnkd.in/gCkB5CpE "(a) The rules in subchapter B of this chapter are applicable to all employers, employees, and commercial motor vehicles that transport property or passengers IN INTERSTATE COMMERCE". (b) The rules in part 383 of this chapter, Commercial Driver's License Standards; Requirements and Penalties, are applicable to every person who operates a commercial motor vehicle, as defined in § 383.5 of this subchapter, IN INTERSTATE OR INTRASTATE COMMERCE and to all employers of such persons." Yes, section (b) implies not even a CDL is required IF there's NO Commerce. DOT regulations make reference to "Trade or Traffic", HOWEVER, the IRS explains what is "Commerce or Trade", find this at- https://lnkd.in/gKWGNe9y or https://lnkd.in/gJTRfVD3. 49 CFR Part 390.5 tells us that a Commercial Motor Vehicle (CMV) is defined as- "Means any self-propelled or towed motor vehicle USED on a highway IN INTERSTATE COMMERCE to transport passengers or property when the vehicle...". View 390.5 CMV definition at- https://lnkd.in/dKnYXb22) Lastly, DOT Regulations technically DO NOT apply when a Driver is on "Personal Conveyance" which is "Out of Commerce". The Following FMCSA link tells us Personal Conveyance "is the movement of a commercial motor vehicle (CMV) for personal use while OFF-DUTY". https://lnkd.in/g9tbs2tP Off-duty, obviously the opposite of On-Duty... which is Defined under 49 CFR 395.2...This is a REQUIREMENT for a DOT Inspection, that can ONLY be done in "While the CMV is in Commerce". Besides it being hysterical with the G-Wagon. A great lesson in Constitutional Law which superceeds DOT. It’s all about the Commerce! Once a party is involved in commerce they are subjected to rules and regulations DOT or not.
