2024 will certainly be another interesting year for copyright lawyers as AI cases mount and progress, legislation is proposed and implemented, and further deals are done between developers and creators. Always an open question is whether the market, courts and legislators can move quickly - and cautiously - enough to provide legal and business clarity that will deliver on the promise of innovation and security for the next generation of creators. Beyond 2024, a looming challenge is how to create a consistent global framework that will ensure the winners and losers in this evolution of technology are not divided along geographic lines. https://lnkd.in/eG4Vdq5G

Hong Kong is moving towards updating its copyright regulations to keep pace with the rapidly developing field of artificial intelligence (#AI). The European Parliament is also taking steps to ensure that the level of AI use by government and private enterprises is in line with the protection of fundamental rights. In April, a vote on proposed AI legislation is scheduled after two committees earlier endorsed a provisional law. Experts in the field have backed changes to the legislation to protect creators who use this technology. A review of the outdated regulations is underway to ensure that they cover #AI. The Beijing Internet Court has ruled in favor of an AI-generated image being considered an artwork protected by copyright laws, encouraging the use of AI tools for creativity. The court's decision is the first of its kind in China and is believed to show support for AI-driven creativity. The ruling requires the defendant to issue a public apology and pay the plaintiff 500 yuan in compensation, setting a precedent for future AI-related cases. This will be an interesting one to watch. My best guess is that even if the AI makers lose this case, the government will allow just them a pass on copyright law or do something to make it so they're able to still develop their AI models. There's too much money backing the AI developers, and lining government officials pockets, for the government to not make them successful. https://lnkd.in/ezi4TkqW

In this article, DLA Piper lawyers Edward Chatterton and Wilson Lung explain a recent Chinese court judgment and review how luxury brands can protect copyright in AI-assisted work. In the recent Li v. Liu decision, the Beijing Internet Court was willing to grant copyright protection over a work created by prompting an AI tool, a more liberal approach than the position the authorities have taken in the United States.
