Belated seasons greetings to my fellow IP aficiandos. Good to be back commenting on all matters copyright and trademarks. Much as I try to advise and support SMEs with IP aspects of their businesses, this time, and I'm not trying to curry favour with LVMH (although a new suitcase would be most welcome), I do think that the large company had cause to ask the question about possible confusion. I'm glad the small company benefitted from the dispute - otherwise the costs would have been crippling, but could it be argued that they brought this problem on themselves? OK, Lawrence and Victoria is LV - but could they not just as easily be VL? Would consumers have been confused by seeing "LV Bespoke" and interpreting the business as LVMH as contested by the luxury brand company? Am I alone in thinking that "LV Bespoke" has a hint of luxury/exclusivity, evoked by "bespoke"? - and that might make me think of LVMH? I think Lawrence and Victoria were fortunate in their Intellectual Property Office Hearing Officer - other "David and Goliath" cases aren't always seen with the same amount of favour towards the "Davids" of the disputes. The takeaway, as ever, is to be very thorough with searches for similar and/or competing brand names/logos/trademarks. Chanel vs What Goes Around Comes Around (WGACA) A six-year legal battle between Chanel and the resale company What Goes Around Comes Around (WGACA) has officially come to an end. In 2018, Chanel filed a lawsuit against WGACA, alleging that the resale company was trying to trade off Chanel’s brand and goodwill. Chanel accused WGACA of using its marketing materials and trademarks on social media, falsely guaranteeing the authenticity of items not verified by Chanel, and implying they are an authorized reseller and affiliated with the brand. The New York jury unanimously voted in favor of Chanel on all counts of: 1. Trademark Infringement 2. False Association 3. Unfair Competition 4. False Advertising Chanel was awarded $4 million in statutory damages. This case sets a strong precedent for resellers to be much more careful in their campaigns and marketing initiatives. Simply using hashtags can initiate the risk of false association.
