Estate planning is also incapacity planning. Bracha Etengoff and others have been posting about this topic for a while now. What is incapacity planning? Well, most of us are basically 24 hours away from being potentially incapacitated. Stroke, accident, etc. I use the analogy, say, you get hit by a Fed Ex truck. I mean that's a nice truck to hit you (great PI money there, deep pockets especially if you are not at fault). And now you are alive but not well. But you will get better. You will recover. So if this happens, who can rush into the emergency room to see you? Grab your phone, talk to your doctors, call your work and report that you won't come in, file for disability, pay your taxes and get you situated in rehab? We all know who it should not be! We don't want you to be laid up in all sorts of contraptions, injured and see the wrong person walk in to take care of you. So smart people set up a durable power of attorney and advance health care directive. These two documents usually become effective when you are incapacitated -- alive, not well but will get better one day -- and permits these folks you named to handle your medical and financial affairs without having to go to court.
